คู่สัญญาซึ่งส่งคู่ฉีกฉบับหนึ่งไปให้เขารับรอง ต้องเขียนแถลงลงในคู่ฉีกฉบับอื่นว่าคู่ฉีกฉบับโน้นอยู่ในมือบุคคลชื่อไร ส่วนบุคคลคนนั้นก็จำต้องสละตั๋วให้แก่ผู้ทรงโดยชอบด้วยกฎหมายแห่งคู่ฉีกฉบับอื่นนั้นถ้าบุคคลคนนั้นบอกปัดไม่ยอมให้ ท่านว่าผู้ทรงยังจะใช้สิทธิไล่เบี้ยไม่ได้จนกว่าจะได้ทำคัดค้านระบุความดังต่อไปนี้ คือ(๑) ว่าคู่ฉีกฉบับซึ่งได้ส่งไปเพื่อรับรองนั้น เขาไม่สละให้แก่ตนเมื่อทวงถาม(๒) ว่าไม่สามารถจะให้เขารับรองหรือใช้เงินด้วยคู่ฉีกฉบับอื่นได้

English translation
A party who sends one part of a set for acceptance must state on the other parts the name of the person in whose hands that part is, and that person must give it up to the lawful holder of any other part. If he refuses, the holder may not exercise his right of recourse until he has made a protest stating: (1) that the part sent for acceptance was not given up to him on demand; (2) that acceptance or payment could not be obtained on another part.
