ในกรณีที่มีเหตุฉุกเฉินซึ่งจำเป็นต้องสืบพยานหลักฐานใดเป็นการเร่งด่วนและไม่สามารถแจ้งให้คู่ความฝ่ายอื่นทราบก่อนได้ เมื่อมีการยื่นคำขอตามมาตรา ๑๐๑ พร้อมกับคำฟ้องหรือคำให้การหรือภายหลังจากนั้น คู่ความฝ่ายที่ขอจะยื่นคำขอฝ่ายเดียวโดยทำเป็นคำร้องรวมไปด้วย เพื่อให้ศาลมีคำสั่งโดยไม่ชักช้าก็ได้ และถ้าจำเป็นจะขอให้ศาลมีคำสั่งให้ยึดหรือให้ส่งต่อศาลซึ่งเอกสารหรือวัตถุที่จะใช้เป็นพยานหลักฐานที่ขอสืบไว้ก่อนด้วยก็ได้
คำร้องตามวรรคหนึ่งต้องบรรยายถึงข้อเท็จจริงที่แสดงว่ามีเหตุฉุกเฉินซึ่งจำเป็นต้องสืบพยานหลักฐานใดโดยเร่งด่วนและไม่สามารถแจ้งให้คู่ความฝ่ายอื่นทราบก่อนได้ รวมทั้งความเสียหายที่จะเกิดขึ้นจากการที่มิได้มีการสืบพยานหลักฐานดังกล่าว ส่วนในกรณีที่จะขอให้ศาลมีคำสั่งให้ยึดหรือให้ส่งต่อศาลซึ่งเอกสารหรือวัตถุที่จะใช้เป็นพยานหลักฐาน คำร้องนั้นต้องบรรยายถึงข้อเท็จจริงที่แสดงถึงความจำเป็นที่จะต้องยึดหรือให้ส่งเอกสารหรือวัตถุนั้นว่ามีอยู่อย่างไร ในการนี้ ห้ามมิให้ศาลอนุญาตตามคำร้องนั้น เว้นแต่จะเป็นที่พอใจของศาลจากการไต่สวนว่ามีเหตุฉุกเฉินและมีความจำเป็นตามคำร้องนั้นจริง แต่ทั้งนี้ ไม่ตัดสิทธิคู่ความฝ่ายอื่นที่จะขอให้ศาลออกหมายเรียกพยานดังกล่าวมาศาล เพื่อถามค้านและดำเนินการตามมาตรา ๑๑๗ ในภายหลัง หากไม่อาจดำเนินการดังกล่าวได้ ศาลต้องใช้ความระมัดระวังในการชั่งน้ำหนักพยานหลักฐาน
English translation
Where there is an emergency that makes it necessary to take some evidence urgently and it is not possible to notify the other party beforehand, then when an application under Section 101 is filed together with the plaint or the answer, or afterwards, the applying party may also file an ex parte application, made in the form of a motion combined with it, for the court to issue an order without delay; and if necessary, it may also request the court to order the seizure of, or the delivery to the court of, the document or object to be used as the evidence sought to be taken in advance.
The motion under paragraph one must describe the facts showing that there is an emergency making it necessary to take some evidence urgently and that the other party cannot be notified beforehand, as well as the damage that will arise from the failure to take such evidence. As for a case where the court is to be asked to order the seizure of, or the delivery to the court of, the document or object to be used as evidence, the motion must describe the facts showing how the necessity to seize or to deliver such document or object exists. In this regard, the court shall not grant such motion unless it is satisfied from an inquiry that an emergency and a necessity as stated in the motion genuinely exist. However, this does not deprive the other party of the right to request the court to issue a summons for such witness to attend court for cross-examination and to proceed under Section 117 later. If such action cannot be taken, the court must exercise caution in weighing the evidence.

Section 101/1 is the emergency, ex parte counterpart to Section 101. It lets a party who has applied to take evidence in advance obtain an immediate order without first notifying the opponent, where an emergency makes urgent taking of evidence necessary, and it may combine a request to seize or compel delivery of a document or object to be used as evidence. The motion must set out concrete facts on the emergency, the inability to give notice, and the anticipated harm; the court may grant it only after being satisfied on inquiry that the emergency and necessity are genuine. To protect the absent party, the section preserves its right to later summon the witness for cross-examination under Section 117, and directs the court to weigh such evidence cautiously where that cannot be done.
