บันทึกถ้อยคำตามมาตรา ๑๒๐/๑ และมาตรา ๑๒๐/๒ ให้มีรายการดังต่อไปนี้
(๑) ชื่อศาลและเลขคดี
(๒) วัน เดือน ปี และสถานที่ที่ทำบันทึกถ้อยคำ
(๓) ชื่อและสกุลของคู่ความ
(๔) ชื่อ สกุล อายุ ที่อยู่ และอาชีพ ของผู้ให้ถ้อยคำ และความเกี่ยวพันกับคู่ความ
(๕) รายละเอียดแห่งข้อเท็จจริง หรือความเห็นของผู้ให้ถ้อยคำ
(๖) ลายมือชื่อของผู้ให้ถ้อยคำและคู่ความฝ่ายผู้เสนอบันทึกถ้อยคำ
ห้ามมิให้แก้ไขเพิ่มเติมบันทึกถ้อยคำที่ได้ยื่นไว้แล้วต่อศาล เว้นแต่เป็นการแก้ไขข้อผิดพลาดหรือผิดหลงเล็กน้อย
English translation
A written statement under Section 120/1 and Section 120/2 shall contain the following particulars:
(1) the name of the court and the case number;
(2) the date, month, year, and place where the written statement is made;
(3) the given name and surname of the parties;
(4) the given name, surname, age, address, and occupation of the maker, and their connection with the parties;
(5) the particulars of the facts or opinions of the maker;
(6) the signature of the maker and of the party submitting the written statement.
No amendment or addition may be made to a written statement already submitted to the court, except a correction of a minor error or slip.
