Section 192 — Converting between small claims and ordinary

เมื่อศาลเห็นว่าคดีที่ฟ้องไม่ใช่คดีมโนสาเร่และศาลนั้นมีเขตอำนาจที่จะพิจารณาคดีนั้นอย่างคดีสามัญได้ ถ้าคดีนั้นได้ฟ้องโดยคำแถลงด้วยวาจา ก็ให้ศาลมีคำสั่งให้โจทก์ยื่นคำฟ้องเป็นหนังสืออย่างคดีสามัญ แต่ถ้าคดีนั้นได้ยื่นคำฟ้องเป็นหนังสืออยู่แล้ว ห้ามมิให้ศาลออกหมายเรียกอย่างอื่นนอกจากที่บัญญัติไว้สำหรับคดีสามัญถ้าคดีนั้นไม่เป็นคดีมโนสาเร่ต่อไป เนื่องจากได้มีคำฟ้องเพิ่มเติมยื่นเข้ามาภายหลัง และศาลนั้นมีเขตอำนาจที่จะพิจารณาคดีนั้นอย่างคดีสามัญได้ ก็ให้ศาลดำเนินการพิจารณาไปอย่างคดีสามัญในกรณีใดกรณีหนึ่งดังกล่าวมาแล้ว ถ้าศาลไม่มีเขตอำนาจพิจารณาคดีนั้นอย่างคดีสามัญ ให้ศาลมีคำสั่งคืนคำฟ้องนั้นไปเพื่อยื่นต่อศาลที่มีเขตอำนาจในกรณีที่จำเลยฟ้องแย้งเข้ามาในคดีมโนสาเร่และฟ้องแย้งนั้นมิใช่คดีมโนสาเร่ หรือในกรณีที่ศาลมีคำสั่งให้พิจารณาคดีสามัญรวมกับคดีมโนสาเร่ ให้ศาลดำเนินการพิจารณาคดีมโนสาเร่ไปอย่างคดีสามัญ แต่เมื่อศาลพิจารณาถึงจำนวนทุนทรัพย์ ลักษณะคดี สถานะของคู่ความ หรือเหตุสมควรประการอื่นแล้วเห็นว่า การนำบทบัญญัติในหมวดนี้ไปใช้บังคับแก่คดีในส่วนของฟ้องแย้งหรือคดีสามัญเช่นว่านั้นจะทำให้การดำเนินคดีเป็นไปด้วยความรวดเร็วและเป็นธรรมแก่คู่ความทุกฝ่าย ก็ให้ศาลมีอำนาจพิจารณาคดีในส่วนของฟ้องแย้งหรือคดีสามัญนั้นอย่างคดีมโนสาเร่ได้ คำสั่งอย่างใดอย่างหนึ่งของศาลตามวรรคสี่ ไม่กระทบถึงค่าขึ้นศาลที่คู่ความแต่ละฝ่ายต้องชำระอยู่ก่อนที่ศาลจะมีคำสั่งเช่นว่านั้น

English translation

When the court is of the opinion that the case filed is not a small claims case and that court has jurisdiction to try the case as an ordinary case, then if the case was filed by an oral statement, the court shall order the plaintiff to submit a written complaint as in an ordinary case; but if the case has already been filed by a written complaint, the court shall not issue any summons other than that prescribed for an ordinary case.
If the case ceases to be a small claims case because an additional complaint has subsequently been submitted, and that court has jurisdiction to try the case as an ordinary case, the court shall proceed to try it as an ordinary case.
In either of the aforesaid cases, if the court has no jurisdiction to try the case as an ordinary case, the court shall order the complaint to be returned for submission to the court having jurisdiction.
Where the defendant files a counterclaim in a small claims case and that counterclaim is not a small claims case, or where the court orders an ordinary case to be tried jointly with a small claims case, the court shall try the small claims case as an ordinary case. However, when the court, having considered the amount in controversy, the nature of the case, the status of the parties, or other reasonable grounds, is of the opinion that applying the provisions of this Chapter to the counterclaim or such ordinary case would make the proceedings speedy and fair to all parties, the court shall have the power to try that counterclaim or ordinary case as a small claims case.
An order of the court under paragraph four shall not affect the court fees that each party is liable to pay before the court makes such an order.

Section 192 governs the movement of a case between the small claims track and the ordinary track. Paragraphs one to three deal with a case that is not, or ceases to be, a small claim: the court converts it to ordinary procedure if it has jurisdiction, or returns the complaint to be filed in the court that does. Paragraph four, added by amendment, gives the court flexibility in the reverse direction: where a non-small-claim counterclaim is filed, or an ordinary case is joined, the court may try that part as a small claim when this is speedy and fair to all parties. Paragraph five preserves the court fees already payable before any paragraph-four order. The amendment was aimed at efficiency, letting a court without ordinary jurisdiction still resolve a related counterclaim together with the main case.
