English translation

When the court is of the opinion that the case filed is not a small claims case and that court has jurisdiction to try the case as an ordinary case, then if the case was filed by an oral statement, the court shall order the plaintiff to submit a written complaint as in an ordinary case; but if the case has already been filed by a written complaint, the court shall not issue any summons other than that prescribed for an ordinary case.
If the case ceases to be a small claims case because an additional complaint has subsequently been submitted, and that court has jurisdiction to try the case as an ordinary case, the court shall proceed to try it as an ordinary case.
In either of the aforesaid cases, if the court has no jurisdiction to try the case as an ordinary case, the court shall order the complaint to be returned for submission to the court having jurisdiction.
Where the defendant files a counterclaim in a small claims case and that counterclaim is not a small claims case, or where the court orders an ordinary case to be tried jointly with a small claims case, the court shall try the small claims case as an ordinary case. However, when the court, having considered the amount in controversy, the nature of the case, the status of the parties, or other reasonable grounds, is of the opinion that applying the provisions of this Chapter to the counterclaim or such ordinary case would make the proceedings speedy and fair to all parties, the court shall have the power to try that counterclaim or ordinary case as a small claims case.
An order of the court under paragraph four shall not affect the court fees that each party is liable to pay before the court makes such an order.

Firm annotation

Section 192 governs the movement of a case between the small claims track and the ordinary track. Paragraphs one to three deal with a case that is not, or ceases to be, a small claim: the court converts it to ordinary procedure if it has jurisdiction, or returns the complaint to be filed in the court that does. Paragraph four, added by amendment, gives the court flexibility in the reverse direction: where a non-small-claim counterclaim is filed, or an ordinary case is joined, the court may try that part as a small claim when this is speedy and fair to all parties. Paragraph five preserves the court fees already payable before any paragraph-four order. The amendment was aimed at efficiency, letting a court without ordinary jurisdiction still resolve a related counterclaim together with the main case.

Why this matters in practice

Watch the jurisdiction point: if your case is filed as a small claim but really is not, the court may switch it to ordinary procedure or, worse, return the complaint so you must refile in the right court, costing time. A counterclaim above the small claims ceiling can also change how the case is handled. If jurisdiction or track is unclear, get advice early, see our guide to choosing a lawyer.

Décisions de la Cour suprême interprétant cette section

  1. Arrêt de la Cour suprême n° 2541/2556 (2013)

A counterclaim, although it must be connected with the original claim in order to be filed with the answer, has the character of a plaint, so filing it is subject to section 2(1). Where the counterclaim's amount in dispute exceeds 300,000 baht it is outside the power of a district court to entertain, under section 17 with section 25(4) of the Courts of Justice Organisation Act. Section 192 paragraph four can be applied only by a court of first instance that already has power to try the case under that Act: it governs the mode of trial and does not confer jurisdiction on a court that otherwise lacks it.

The plaintiff sued in a district court for 244,375 baht with interest, and the defendant filed a counterclaim whose amount in dispute exceeded 300,000 baht. The defendant argued that section 192 paragraph four as amended allowed the court to try the counterclaim with the original claim. The Supreme Court rejected that. A counterclaim, though connected with the original claim, has the character of a plaint and its filing is subject to section 2(1); exceeding 300,000 baht, it was outside the district court's power under section 17 with section 25(4) of the Courts of Justice Organisation Act. Section 192 paragraph four applies only where the court of first instance already has power to try the case under that Act.
