เพื่อความเหมาะสมสำหรับคดีบางประเภท หรือเพื่อให้การดำเนินกระบวนพิจารณา หรือการบังคับคดีเป็นไปโดยสะดวก รวดเร็ว และเที่ยงธรรม ประธานศาลฎีกามีอำนาจออกข้อกำหนดใด ๆ ที่ไม่ขัดหรือแย้งกับบทบัญญัติในหมวดนี้ได้ดังนี้
(๑) กำหนดคุณสมบัติ ส่วนได้เสีย รวมตลอดทั้งการได้มาซึ่งสิทธิการเป็นสมาชิกกลุ่มของโจทก์ที่จะมีอำนาจฟ้องคดีแบบกลุ่มได้
(๒) กำหนดเพิ่มเติมเกี่ยวกับหลักเกณฑ์ วิธีการ และเงื่อนไขในการพิจารณาอนุญาตให้ดำเนินคดีแบบกลุ่ม
(๓) กำหนดเพิ่มเติมเกี่ยวกับวิธีการแจ้งเรื่องการดำเนินคดีแบบกลุ่มให้สมาชิกกลุ่มทราบ
(๔) กำหนดเพิ่มเติมเกี่ยวกับวิธีการนัดพร้อม การแก้ไขคำฟ้องและคำให้การ การดำเนินกระบวนพิจารณาและการรับฟังพยานหลักฐาน ในการดำเนินคดีแบบกลุ่ม
(๕) กำหนดเพิ่มเติมเกี่ยวกับการบังคับคดีและเงินรางวัลของทนายความฝ่ายโจทก์
(๖) ออกข้อกำหนดเกี่ยวกับเรื่องที่จำเป็นอื่น ๆ ในการดำเนินคดีแบบกลุ่ม

English translation
For the appropriateness of certain types of cases, or in order to make the conduct of proceedings or the execution of judgment convenient, expeditious and just, the President of the Supreme Court shall have the power to issue any rules not contrary to or inconsistent with the provisions of this Chapter, as follows:
(1) prescribing the qualifications, the interest, and the acquisition of the status of class member, of a plaintiff who is to have the power to bring a class action;
(2) prescribing additional criteria, methods and conditions for the consideration of permission to proceed as a class action;
(3) prescribing additional methods for notifying class members of the class action proceeding;
(4) prescribing additional methods for the pre-trial conference, the amendment of the complaint and the answer, the conduct of proceedings and the admission of evidence in a class action proceeding;
(5) prescribing additional matters concerning the execution of judgment and the reward of the plaintiff's lawyer;
(6) issuing rules on other necessary matters in the conduct of a class action.
Such rules, once they have received the approval of the plenary session of the Supreme Court and have been published in the Government Gazette, shall come into force.

This is the rule-making provision of the class action chapter, added by the amendment of B.E. 2558 (2015). Because the statute sets only the framework, it delegates the operational detail to the President of the Supreme Court, subject to two controls: the rules may not conflict with the chapter, and they take effect only after approval by the plenary session of the Supreme Court and publication in the Government Gazette. The six listed heads track the life of a class action, from who may be the plaintiff, through certification, notice, trial management and evidence, to enforcement and the lawyer's reward. A practitioner handling a class action must therefore read this chapter together with the current Supreme Court rules on class actions.
