Firm annotation

This is a content-of-notice checklist that gives teeth to the objection and opt-out rights created in sections 222/28, 222/29 and 222/30. Because absent group members can only exercise those rights if they understand what is happening, the law prescribes seven mandatory particulars, ranging from basic case identification to a clear explanation of members' rights and the consequences of the court's permission and of opting out. Item (3)'s requirement of a clear description of the group ties back to the certification definition, and item (6) ensures members grasp what they lose or keep by withdrawing. A notice missing these particulars risks being treated as defective, undermining the validity of any withdrawal, settlement, or arbitration referral it supports.

Why this matters in practice

If you receive a notice about a class action you belong to, read it against this list: it should tell you the court and case, describe the group, explain what stage the case is at, and spell out your rights and what happens if you object or opt out. A vague or incomplete notice can be challenged. For plaintiffs and their lawyers, drafting the notice correctly is not a formality; a defective notice can derail a settlement or withdrawal approval. When in doubt about whether a notice affects your rights, seek advice promptly because deadlines run from these notices.

Frequently asked questions

What must a class action notice to group members include?

Under section 222/31 the notice must state the court and case number, the parties' names and addresses, a summary of the claim and the group, what has been done and why notice is given, members' rights, the effect of the court's approval, the effect of opting out, and the issuing judge's name.

What happens if a class action notice is incomplete?

A notice missing the mandatory particulars in section 222/31 may be treated as defective, which can undermine the validity of the withdrawal, settlement, or arbitration referral it supports.
