Section 222/39 — Notice of judgment and debt claims

ให้ศาลแจ้งคำพิพากษาให้สมาชิกกลุ่มทราบตามวิธีการเช่นเดียวกับที่กำหนดไว้ในมาตรา ๒๒๒/๑๕ วรรคหนึ่ง และให้แจ้งอธิบดีกรมบังคับคดีทราบด้วย
ในกรณีที่ศาลมีคำพิพากษาให้จำเลยชำระหนี้เป็นเงินหรือชำระหนี้เป็นเงินรวมอยู่ด้วย ให้ศาลตั้งเจ้าพนักงานบังคับคดีเพื่อดำเนินการต่อไป รวมทั้งกำหนดวันตามที่เห็นสมควรในคำบอกกล่าวและประกาศตามวรรคหนึ่ง เพื่อให้สมาชิกกลุ่มยื่นคำขอรับชำระหนี้ต่อเจ้าพนักงานบังคับคดี แต่ถ้าเป็นกรณีที่ศาลมีคำพิพากษาให้จำเลยชำระหนี้อย่างอื่นและจำเป็นจะต้องมีการดำเนินการอย่างหนึ่งอย่างใดเพื่อประโยชน์แก่การบังคับตามคำพิพากษา โจทก์อาจยื่นคำขอต่อศาลเพื่อตั้งเจ้าพนักงานบังคับคดีดำเนินการได้
เมื่อพ้นกำหนดระยะเวลาตามวรรคสอง สมาชิกกลุ่มที่ไม่ได้ยื่นคำขอรับชำระหนี้ไม่มีสิทธิขอเฉลี่ยทรัพย์สินหรือเงินในการบังคับคดีตามส่วนนี้ เว้นแต่ในกรณีที่มีเหตุสุดวิสัย สมาชิกกลุ่มที่ไม่ได้ยื่นคำขอรับชำระหนี้ภายในกำหนดระยะเวลา อาจยื่นคำขอรับชำระหนี้ต่อเจ้าพนักงานบังคับคดีได้ภายในสามสิบวันนับแต่วันพ้นกำหนดระยะเวลา

English translation

The court shall notify the group members of the judgment by the same method as prescribed in section 222/15 paragraph one, and shall also notify the Director-General of the Legal Execution Department.
Where the court renders judgment ordering the defendant to pay a debt in money, or including the payment of money, the court shall appoint an execution officer to proceed further, and shall also fix a date, as it deems appropriate, in the notice and public notice under paragraph one, for the group members to file requests for payment of the debt with the execution officer. However, where the court renders judgment ordering the defendant to discharge the debt in another form and it is necessary to take some action for the benefit of the execution of the judgment, the plaintiff may file a request with the court to appoint an execution officer to proceed.
When the period under paragraph two has elapsed, group members who have not filed requests for payment of the debt have no right to request a pro rata share of the property or money in the execution under this Part, except in a case of force majeure, where group members who have not filed requests for payment of the debt within the period may file requests for payment of the debt with the execution officer within thirty days from the expiration of the period.
