Section 291 — Resuming a stayed execution

ในกรณีที่เจ้าพนักงานบังคับคดีได้งดการบังคับคดีไว้ตามคำสั่งของศาล ให้เจ้าพนักงานบังคับคดีดำเนินการบังคับคดีต่อไปเมื่อได้รับคำสั่งจากศาล โดยศาลเป็นผู้ออกคำสั่งนั้นเองหรือโดยเจ้าหนี้ตามคำพิพากษาเป็นผู้ยื่นคำขอให้ศาลออกคำสั่ง เนื่องจากระยะเวลาที่ให้งดการบังคับคดีนั้นได้ล่วงพ้นไปแล้ว หรือมิได้เป็นไปตามเงื่อนไขที่ศาลได้กำหนดไว้ หรือคดีนั้นศาลอุทธรณ์หรือศาลฎีกาได้พิพากษายืนหรือไม่มีความจำเป็นที่จะต้องงดการบังคับคดีอีกต่อไปแล้ว
ในกรณีที่เจ้าพนักงานบังคับคดีได้งดการบังคับคดีไว้ตามมาตรา ๒๘๙
(๓) หรือ
(๔) ให้เจ้าพนักงานบังคับคดีดำเนินการบังคับคดีต่อไปเมื่อระยะเวลาที่ให้งดการบังคับคดีได้ล่วงพ้นไปแล้ว หรือมิได้เป็นไปตามเงื่อนไขที่เจ้าหนี้ตามคำพิพากษาได้กำหนดไว้ หรือเจ้าหนี้ผู้ขอบังคับคดีได้ปฏิบัติตามมาตรา ๑๕๔ แล้ว

English translation

Where the executing officer has stayed the execution pursuant to an order of the court, the executing officer shall proceed with the execution upon receiving an order from the court, whether the court issues that order on its own or the judgment creditor files an application for the court to issue the order, because the period of the stay has elapsed, or the conditions set by the court have not been met, or the Court of Appeal or the Supreme Court has affirmed the judgment in that case, or there is no longer any need to stay the execution.
Where the executing officer has stayed the execution under Section 289 (3) or (4), the executing officer shall proceed with the execution when the period of the stay has elapsed, or the conditions set by the judgment creditor have not been met, or the creditor who applied for execution has complied with Section 154.
