Section 308: Seizing patent and trademark rights

การยึดสิทธิในสิทธิบัตร สิทธิในเครื่องหมายการค้า หรือสิทธิอย่างอื่นของลูกหนี้ตามคำพิพากษาที่มีลักษณะคล้ายคลึงกันหรือที่เกี่ยวเนื่องกันกับสิทธิดังกล่าว ซึ่งได้จดทะเบียนหรือขึ้นทะเบียนไว้แล้ว ให้เจ้าพนักงานบังคับคดีกระทำโดย
(๑) แจ้งรายการสิทธิที่ยึดให้ลูกหนี้ตามคำพิพากษาทราบ ถ้าไม่สามารถกระทำได้ ให้ดำเนินการตามวิธีการที่บัญญัติไว้ในมาตรา ๓๐๕ วรรคสอง
(๒) แจ้งให้นายทะเบียนหรือพนักงานเจ้าหน้าที่ผู้มีอำนาจหน้าที่จดทะเบียนตามกฎหมายว่าด้วยการนั้นบันทึกการยึดไว้ในทะเบียน
English translation
The seizure of a right in a patent, a right in a trademark, or any other right of the judgment debtor of a similar nature or connected with such rights, which has been registered or entered in a register, shall be carried out by the executing officer by:
(1) giving notice of the list of the seized rights to the judgment debtor; if this cannot be done, proceeding in accordance with the method provided in Section 305, paragraph two;
(2) giving notice to the registrar or the competent official empowered to register under the law governing that matter to record the seizure in the register.
