English translation
For the seizure of a bill of exchange or any other negotiable instrument of the judgment debtor, the provisions of Section 305, paragraph one (2) and paragraph two, shall apply mutatis mutandis, and this shall also have the effect of attaching the claim under that bill of exchange or instrument.
Where the executing officer sees fit, the officer may request the court to order that it be disposed of at the value appearing on the bill of exchange or instrument, or at a lower value as the court sees fit. If the court dismisses the request, the bill of exchange or instrument shall be put up for public auction.

Firm annotation
This section, in Part 3, extends the securities seizure method to negotiable instruments such as bills of exchange, and makes clear that seizing the instrument also attaches the underlying claim to payment. It gives the executing officer a practical choice: seek a court order to dispose of the instrument at its stated or a lower value, or, failing that, sell it by public auction. Older Supreme Court decisions citing Section 306 typically address the pre-2017 numbering on notice of auction to interested persons, so they should be read against the current text.
Why this matters in practice
A promissory note or bill held by the debtor can be reached in execution, and seizing it also captures the right to be paid on it. Because the officer may seek a court-approved sale at face or lower value before auction, be ready to argue the instrument's real worth if you are the creditor or the debtor. Watch for defenses of the party liable on the instrument.

Frequently asked questions
How is a bill of exchange seized in execution?
Under Section 306, the executing officer seizes it using the securities method in Section 305, and the seizure also attaches the claim to payment under the instrument. The officer may then seek court approval to dispose of it, or sell it by auction.
Can a seized negotiable instrument be sold below its face value?
Yes, if the executing officer requests and the court allows disposal at the value on the instrument or a lower value. If the court dismisses the request, the instrument is put up for public auction.
