Section 320 — Effect of attachment of claims

การอายัดสิทธิเรียกร้องนั้นให้มีผลดังต่อไปนี้
(๑) การที่ลูกหนี้ตามคำพิพากษาได้ก่อให้เกิดสิทธิแก่บุคคลภายนอกเหนือสิทธิเรียกร้องที่ได้ถูกอายัด โอน เปลี่ยนแปลง หรือระงับซึ่งสิทธิเรียกร้องดังกล่าวภายหลังที่ได้ทำการอายัดไว้แล้วนั้น หาอาจใช้ยันแก่เจ้าหนี้ตามคำพิพากษาหรือเจ้าพนักงานบังคับคดีได้ไม่ถึงแม้ว่าราคาแห่งสิทธิเรียกร้องนั้นจะเกินกว่าจำนวนหนี้ตามคำพิพากษากับค่าฤชาธรรมเนียมและค่าฤชาธรรมเนียมในการบังคับคดี และลูกหนี้ตามคำพิพากษาได้กระทำการดังกล่าวแก่สิทธิเรียกร้องที่ถูกอายัดเพียงส่วนที่มีราคาเกินจำนวนนั้นก็ตาม
ความในวรรคหนึ่งมิให้ใช้บังคับแก่ผู้จำนองหรือผู้จำนำซึ่งมิใช่ลูกหนี้ตามสิทธิเรียกร้องตามมาตรา ๓๑๙ วรรคสอง หากผู้จำนองหรือผู้จำนำพิสูจน์ได้ว่าความระงับสิ้นไปแห่งการจำนองหรือการจำนำเกิดขึ้นโดยผู้จำนองหรือผู้จำนำกระทำการโดยสุจริตและเสียค่าตอบแทนก่อนมีการแจ้งการอายัดไปยังผู้จำนองหรือผู้จำนำเพื่อทราบ
(๒) ถ้าค่าแห่งสิทธิเรียกร้องซึ่งอายัดไว้นั้นต้องเสื่อมเสียไปเพราะความผิดของเจ้าหนี้ตามคำพิพากษา เจ้าหนี้ตามคำพิพากษาต้องรับผิดชดใช้ค่าสินไหมทดแทนให้แก่ลูกหนี้ตามคำพิพากษาเพื่อความเสียหายใด ๆ ซึ่งเกิดขึ้นแก่ลูกหนี้ตามคำพิพากษานั้น
(๓) การชำระหนี้โดยบุคคลภายนอกตามที่ระบุไว้ในคำสั่งอายัดนั้นให้ถือว่าเป็นการชำระหนี้ตามกฎหมาย

English translation

The attachment of a claim shall have the following effects:
(1) Any act by which the judgment debtor creates a right in favor of a third party over the attached claim, or transfers, alters, or extinguishes such claim, after the attachment has been made, cannot be set up against the judgment creditor or the execution officer, even if the value of the claim exceeds the amount of the judgment debt together with the court costs and the costs of execution, and even if the judgment debtor did so only with respect to the portion of the claim whose value exceeds that amount.
The provision of paragraph one shall not apply to a mortgagor or pledgor who is not the debtor of the claim under Section 319 paragraph two, if the mortgagor or pledgor can prove that the extinction of the mortgage or pledge occurred through an act done in good faith and for value before notice of the attachment was given to the mortgagor or pledgor for their information.
(2) If the value of the attached claim must deteriorate through the fault of the judgment creditor, the judgment creditor shall be liable to pay compensation to the judgment debtor for any damage caused to the judgment debtor.
(3) Performance of the obligation by the third party as specified in the attachment order shall be deemed to be a performance in accordance with the law.

Section 320 states the effects of attaching a claim and is the counterpart, for claims, of Section 315 on the effect of seizing property. Paragraph (1) freezes the attached claim: the debtor's later creation, transfer, alteration, or discharge of it cannot be set up against the creditor or the officer, even beyond the debt, subject to an exception protecting a third-party mortgagor or pledgor under Section 319 paragraph two who acted in good faith and for value before receiving notice. Paragraph (2) makes the creditor liable if its own fault erodes the claim's value, and paragraph (3) gives the third party a good discharge when it pays as the order directs. It sits in Part 4 on the attachment of claims and was renumbered by the Civil Procedure Code Amendment Act (No. 30) B.E. 2560 (2017).

Why this matters in practice

For a third party served with an attachment order, paragraph (3) is the safe harbor: pay exactly as the order says and you are discharged, even though you did not pay the debtor. For debtors, any attempt to assign or cancel the attached claim after the order is worthless against the creditor. Creditors should note the flip side in paragraph (2): if their own conduct damages the attached claim, they can be made to compensate the debtor. Sorting out who bears what here is a common reason to consult a debt collection lawyer.

Frequently asked questions

Is a third party protected if it pays according to the attachment order?

Yes. Under Section 320(3), performance by the third party as specified in the attachment order is deemed a lawful performance, so it discharges the third party even though it did not pay the debtor.

Can the debtor cancel the attached claim after attachment?

The debtor may try, but under Section 320(1) any transfer, alteration, or discharge of the attached claim after the attachment cannot be set up against the judgment creditor or the execution officer.
