ภายใต้บังคับมาตรา ๓๓๒ และมาตรา ๓๓๖ เมื่อได้ยึดทรัพย์สินหรืออายัดสิทธิเรียกร้องทั้งหมดหรือบางส่วนของลูกหนี้ตามคำพิพากษา หรือได้มีการส่งมอบทรัพย์สินตามสิทธิเรียกร้องที่ถูกอายัดแก่เจ้าพนักงานบังคับคดีแล้ว ถ้าไม่มีเหตุสมควรงดการบังคับคดีไว้ก่อน ให้เจ้าพนักงานบังคับคดีดำเนินการขายทอดตลาดทรัพย์สินหรือสิทธิเรียกร้องนั้นตามประมวลกฎหมายแพ่งและพาณิชย์ และกฎกระทรวงว่าด้วยการนั้นหรือตามที่ศาลมีคำสั่งกำหนด หรือขายโดยวิธีการทางอิเล็กทรอนิกส์ตามที่กำหนดในกฎกระทรวง

English translation
Subject to Section 332 and Section 336, when all or part of the property of the judgment debtor has been seized or the claim attached, or when property under an attached claim has been delivered to the execution officer, then, if there is no proper cause to suspend the execution beforehand, the execution officer shall proceed to sell the property or the claim by public auction in accordance with the Civil and Commercial Code and the ministerial regulations concerning the matter, or as the court may order, or shall sell by electronic means as prescribed in the ministerial regulations.
Before the public auction of the property or the claim under paragraph one, the execution officer must notify the date, time and place at which the auction is to be held to all persons having an interest in the execution who appear from the register or otherwise. The auction may be held on a holiday or at any time outside normal working hours. The date and time so fixed for the auction must be not less than sixty days from the date of the seizure, attachment or delivery of the property.
In order that the auction may be conducted fairly, a person having an interest in the execution has the full right to enter bids himself or to find another person to enter bids so as to obtain the price he desires. Once the execution officer has knocked down the sale to the highest bidder, no person having an interest in the execution may raise the ground that the price obtained from the auction is unduly low as a reason to seek revocation of that auction.

Section 331 is the core provision of Part 8 on sale or disposal. It requires the execution officer, once seizure or attachment is complete and no ground exists to suspend, to sell by public auction, by the method fixed by the court, or by electronic means under ministerial regulation. Paragraph two imposes a mandatory notice to interested persons appearing on the register or otherwise, with a minimum sixty-day lead time from seizure, attachment or delivery. Paragraph three, added in the 2017 restructuring of the execution rules, guarantees interested persons a full right to bid and then bars them from using an unduly low sale price alone as a ground to revoke a completed auction, encouraging them to protect value by bidding rather than by later challenge. It operates subject to Sections 332 (urgent or difficult sales) and 336 (management in lieu of sale).
Why this matters in practice
If you are a mortgagee, co-owner or other interested person, watch the auction date and turn up to bid: paragraph three means you cannot later void the sale simply by arguing the price was too low. The sixty-day notice period is your window to prepare, arrange finance and, if needed, challenge defects other than price. Under Section 331 paragraph three, a person interested in the execution has the full right to bid; a mortgagee entitled to set off its debt against the price who did not post bid security first acted properly, not out of negligence.
The applicant was a mortgagee creditor entitled to deduct or set off its debt against the auction price. The court, quoting Section 331 paragraph three on the full right of interested persons to bid, held that its failure to place security before bidding was proper and not the result of negligence or fault.

Under Section 331 paragraph two, before auctioning, the execution officer must notify the date, time and place to persons interested in the execution appearing from the register or otherwise, which under Section 287(4) includes co-owners and holders of preferential rights.
