Section 332 — Urgent or difficult sales

ในกรณีที่ทรัพย์สินหรือสิทธิเรียกร้องที่จะขายหรือจำหน่ายมีสภาพเป็นของสดของเสียได้ หรือถ้าหน่วงช้าไว้จะเป็นการเสี่ยงความเสียหาย หรือค่าใช้จ่ายจะเกินส่วนแห่งค่าของทรัพย์สินหรือสิทธิเรียกร้องนั้น ให้เจ้าพนักงานบังคับคดีขายหรือจำหน่ายได้ทันทีโดยวิธีขายทอดตลาดหรือวิธีอื่นที่สมควร
ในกรณีที่การขายหรือจำหน่ายทรัพย์สินที่ถูกยึดหรือที่ได้มีการส่งมอบตามคำสั่งอายัดกระทำได้โดยยาก หรือการขายหรือจำหน่ายสิทธิเรียกร้องนั้นกระทำได้โดยยากเนื่องจากการชำระหนี้นั้นต้องอาศัยการชำระหนี้ตอบแทนหรือด้วยเหตุอื่นใด และการบังคับคดีอาจล่าช้าเป็นการเสียหายแก่คู่ความทุกฝ่ายหรือฝ่ายใดฝ่ายหนึ่ง หรือแก่บุคคลผู้มีส่วนได้เสีย เมื่อเจ้าพนักงานบังคับคดีเห็นสมควรหรือคู่ความหรือบุคคลเช่นว่านั้นร้องขอ เจ้าพนักงานบังคับคดีจะมีคำสั่งกำหนดให้จำหน่ายโดยวิธีการอื่นใดที่สมควรก็ได้ ทั้งนี้ บุคคลผู้มีส่วนได้เสียในการบังคับคดีอาจคัดค้านคำสั่งหรือการดำเนินการของเจ้าพนักงานบังคับคดี โดยยื่นคำร้องต่อศาลภายในสองวันนับแต่วันที่ได้ทราบคำสั่งหรือการดำเนินการนั้น คำสั่งของศาลให้เป็นที่สุด

English translation

Where the property or the claim to be sold or disposed of is perishable in nature, or where delay would create a risk of loss, or where the expense would exceed a proportionate share of the value of that property or claim, the execution officer may sell or dispose of it at once by public auction or by any other suitable method.
Where the sale or disposal of seized property, or of property delivered under an attachment order, can be effected only with difficulty, or where the sale or disposal of a claim can be effected only with difficulty because performance of it depends on a counter-performance or on some other cause, and the execution may be delayed to the detriment of all the parties or of any one party, or of a person having an interest, then, when the execution officer sees fit or a party or such a person so requests, the execution officer may order that it be disposed of by any other suitable method. A person having an interest in the execution may object to the order or to the action of the execution officer by filing a request with the court within two days from the day on which he became aware of that order or action. The order of the court shall be final.

Section 332 is an exception, expressly referenced in Section 331, to the ordinary sixty-day auction procedure. Paragraph one allows an immediate sale, by auction or other suitable method, for perishable goods or where delay or disproportionate cost would erode value. Paragraph two addresses claims or property that are hard to sell, for example where a claim depends on a counter-performance, and lets the officer, on his own view or on request, adopt another suitable method of disposal. It safeguards interested persons with a short two-day window to object to the court, whose order is final. The provision balances speed of realisation against the interests of the parties.
