Section 341 — Hearing objections to the account

ในกรณีที่มีผู้ยื่นคำแถลงคัดค้านตามมาตรา ๓๔๐ ให้เจ้าพนักงานบังคับคดีออกหมายเรียกเจ้าหนี้ตามคำพิพากษาทุกคน ผู้ทรงสิทธิเหนือทรัพย์สินนั้น เจ้าของรวม และลูกหนี้ตามคำพิพากษา มาชี้แจงในเวลาและ ณ สถานที่ที่กำหนด โดยต้องแจ้งให้ทราบล่วงหน้าไม่น้อยกว่าสามวัน บุคคลดังกล่าวจะไปตามหมายเรียกด้วยตนเองหรือจะมอบให้ผู้รับมอบอำนาจไปกระทำการแทนก็ได้
เมื่อได้ตรวจพิจารณาคำแถลงคัดค้านและได้ฟังคำชี้แจงของผู้ซึ่งมาตามหมายเรียกแล้ว ให้เจ้าพนักงานบังคับคดีทำคำสั่งยืนตามหรือแก้ไขบัญชีส่วนเฉลี่ยนั้นแล้วอ่านคำสั่งดังกล่าวให้ผู้ซึ่งมาตามหมายเรียกฟังและให้ลงลายมือชื่อรับทราบไว้

English translation

Where a person has filed a statement of objection under Section 340, the execution officer shall issue a summons to every judgment creditor, to the holders of rights over that property, to the co-owners and to the judgment debtor, to give their explanations at the time and place fixed, giving them not less than three days' advance notice. Such persons may attend in accordance with the summons in person or may authorise a representative to act on their behalf.
When the execution officer has examined the statement of objection and heard the explanations of those who have attended in accordance with the summons, the officer shall make an order affirming or amending that distribution account, and shall read the order to those who have attended in accordance with the summons and have them sign to acknowledge it.
Where the order cannot be made within the day fixed, the execution officer shall inform those who have attended in accordance with the summons or the appointment of the date fixed for reading the postponed order, and have them sign to acknowledge it.
If a person under paragraph one does not attend in accordance with the summons or the appointment of the execution officer, that person shall be regarded as having been informed of the appointed date and of the order of the execution officer.

Section 341 sets out the procedure the execution officer follows once a distribution account under Section 340 is challenged. All interested persons are summoned with at least three days' notice and may appear in person or by proxy. After examining the objection and hearing explanations, the officer either affirms or amends the account, reads the order to those present and takes their acknowledgment. Provision is made for postponed orders and, importantly, a deemed-notice rule treats absentees as informed of both the date and the order, preventing obstruction by non-attendance. The officer's resulting order can then be challenged in court under Section 342.

Why this matters in practice

If you have objected, or others have, attend the officer's hearing or send a representative: the deemed-notice rule means a no-show is treated as having heard the date and the order, and the clock to challenge in court starts running from the reading. Bring documents that prove your ranking or the amount you are owed, because this is where the account is actually revised.
