เมื่อเจ้าพนักงานบังคับคดีเห็นว่า ถ้าจะเลื่อนการจ่ายส่วนเฉลี่ยไปจนกว่าได้จำหน่ายทรัพย์สินที่ประสงค์จะบังคับทั้งหมดหรือจนกว่าการเรียกร้องทั้งหมดที่มาสู่ศาลได้เสร็จเด็ดขาดแล้วจะทำให้บุคคลผู้มีส่วนเฉลี่ยในเงินรายได้แห่งทรัพย์สินที่บังคับนั้นทุกคนหรือคนใดคนหนึ่งได้รับความเสียหาย เจ้าพนักงานบังคับคดีมีสิทธิที่จะแบ่งเงินรายได้เท่าที่พอแก่การที่จะจ่ายให้ดังที่บัญญัติไว้ในมาตรา ๓๔๐ มาตรา ๓๔๑ และมาตรา ๓๔๒ ได้ ในเมื่อเจ้าพนักงานบังคับคดีได้กันเงินไว้สำหรับชำระค่าฤชาธรรมเนียมในการบังคับคดีทั้งหมดที่เกิดขึ้นหรือจะเกิดขึ้นต่อไป และสำหรับชำระการเรียกร้องใด ๆ ที่ยังมีข้อโต้แย้งไว้แล้ว

Where the execution officer is of the opinion that to postpone the distribution until all the property intended to be executed against has been disposed of, or until all the claims brought before the court have been finally settled, would cause loss to all or any one of the persons entitled to share in the income from the property under execution, the execution officer shall have the right to distribute the income to the extent sufficient to make the payments provided in Section 340, Section 341 and Section 342, provided that the execution officer has set aside money to pay all the fees of execution that have arisen or will arise, and to pay any claims that are still in dispute.

Section 343 closes Part 10 by allowing a provisional distribution. Where holding back all the money until every asset is sold and every claim finally decided would prejudice those entitled to share, the officer may pay out the available proceeds under the mechanics of Sections 340 to 342 without waiting for completion. The safeguard is a mandatory reserve: enough must be set aside to cover all execution fees, present and future, and any claims still in dispute, so that a provisional payment does not defeat proper priorities later.
