English translation

In the execution of a case where a judgment or order of the court directs the judgment debtor to return or deliver specific property to the judgment creditor, if the provisions of this Chapter do not prescribe a specific method of execution, the provisions of Chapter 2 on the execution of money debts shall apply mutatis mutandis.

Firm annotation

This provision opens Chapter 3 on execution for the return or delivery of specific property and acts as a bridge to the detailed money-debt regime in Chapter 2. Rather than repeating seizure, sale and distribution machinery, it directs that where Chapter 3 is silent the Chapter 2 rules apply mutatis mutandis. It ensures a complete procedure for delivery judgments while letting the following sections address only the features unique to specific property. It was restructured by the Civil Procedure Code Amendment Act (No. 30) B.E. 2560, which reorganised the execution provisions.

Why this matters in practice

If your judgment orders the other side to hand back a specific thing, such as a titled vehicle or a particular parcel of land, the executing officer can draw on the full money-debt toolkit where Chapter 3 has no special rule. In practice that means seizure powers and the officer's procedures still back up a delivery order. Understand which rules apply before you file for execution, because it affects fees and steps. Reviewing the judgment with a lawyer avoids delay; see what to know before you go to court in Thailand.

Frequently asked questions

How is a judgment to return specific property enforced in Thailand?

Through Chapter 3 of the Civil Procedure Code. Where Chapter 3 has no special rule, Section 346 directs that the Chapter 2 money-debt execution rules, including seizure procedures, apply by analogy.

What does mutatis mutandis mean here?

It means the money-debt rules apply with the necessary changes to fit a delivery case. The executing officer adapts those procedures rather than following them literally where the context differs.
