การบังคับคดีในกรณีที่คำพิพากษาหรือคำสั่งของศาลกำหนดให้ลูกหนี้ตามคำพิพากษางดเว้นกระทำการ เจ้าหนี้ตามคำพิพากษาอาจขอให้ศาลมีคำสั่งจับกุมและกักขังลูกหนี้ตามคำพิพากษาตามมาตรา ๓๖๑ และขอให้ศาลมีคำสั่งอย่างหนึ่งอย่างใด ดังต่อไปนี้ได้ด้วย
(๑) ให้ลูกหนี้ตามคำพิพากษาชำระค่าสินไหมทดแทนสำหรับความเสียหายอันเกิดจากการไม่งดเว้นกระทำการนั้น
(๒) รื้อถอนหรือทำลายทรัพย์สินอันเกิดจากการไม่งดเว้นกระทำการนั้น เว้นแต่ในกรณีที่กฎหมายว่าด้วยการนั้นได้กำหนดวิธีการจัดการกับทรัพย์สินดังกล่าวไว้เป็นอย่างอื่นแล้ว
ในกรณีตาม
(๑) เมื่อศาลไต่สวนแล้วเห็นว่าคำขอนั้นฟังได้ ให้ศาลมีคำสั่งให้ลูกหนี้ตามคำพิพากษาชดใช้ค่าสินไหมทดแทนตามจำนวนที่ศาลเห็นสมควร
ในกรณีที่ศาลมีคำสั่งตาม
(๒) ให้ศาลแจ้งคำสั่งให้เจ้าพนักงานบังคับคดีทราบ แล้วให้เจ้าพนักงานบังคับคดีดำเนินการให้เป็นไปตามคำสั่งศาล โดยลูกหนี้ตามคำพิพากษาเป็นผู้รับผิดในค่าใช้จ่าย
การขอและการดำเนินการตามมาตรานี้ ไม่ต้องเสียค่าธรรมเนียมศาล ส่วนค่าสินไหมทดแทนที่ศาลกำหนดตามวรรคสองและค่าใช้จ่ายตามวรรคสาม ให้ถือว่าเป็นหนี้ตามคำพิพากษาที่จะบังคับคดีกันต่อไป
English translation
For the execution of a judgment or order of the court that requires the judgment debtor to refrain from doing an act, the judgment creditor may apply for the court to order the arrest and detention of the judgment debtor under Section 361, and may also apply for the court to make any of the following orders:
(1) to order the judgment debtor to pay compensation for the damage arising from the failure to refrain from that act;
(2) to remove or destroy the property arising from the failure to refrain from that act, unless the law governing that matter has prescribed another method for dealing with such property.
In the case under (1), when the court has held an inquiry and is of the view that the application is well-founded, the court shall order the judgment debtor to pay compensation in the amount that the court considers appropriate.
Where the court makes an order under (2), the court shall notify the order to the execution officer, and the execution officer shall carry out the order of the court, with the judgment debtor being liable for the expenses.
The application and the proceedings under this section are exempt from court fees. As for the compensation determined by the court under paragraph two and the expenses under paragraph three, they shall be deemed a judgment debt to be enforced further.

Section 359 opens Part 2 on the execution of judgments ordering a party to refrain from an act, one of the specific enforcement regimes rebuilt by the Civil Procedure Code Amendment Act (No. 30) B.E. 2560 (2017). Because a negative obligation cannot be seized or sold, the section gives the creditor three coordinated tools: coercive arrest and detention through the cross-reference to Section 361, monetary compensation assessed after a court inquiry, and physical removal or destruction of the offending property carried out by the execution officer. Compensation and removal expenses are converted into a fresh judgment debt, which loops back into ordinary money-judgment execution.

This is the section to invoke when a defendant keeps breaching a negative order, for example continuing to build over a boundary, running a business the court barred, or repeating an act of nuisance. Three points matter in practice: the compensation is fixed by the court only after an inquiry, so bring concrete proof of loss; removal or destruction happens at the debtor's expense but only where no other statute prescribes a different way to deal with the property; and although filing the request is free of court fees, the resulting compensation and cost figures become an ordinary judgment debt you then have to enforce by the usual seizure route. Because the arrest track under Section 361 is drastic, most litigants pair it with a consultation before applying.
