Section 83 quater — Plaintiff's duties for service abroad

ในกรณีที่จะต้องส่งหมายเรียกและคำฟ้องตั้งต้นคดีตาม มาตรา ๘๓ ทวิ แก่จำเลย ณ ภูมิลำเนาหรือสำนักทำการงานของจำเลยนอกราชอาณาจักร ให้โจทก์ยื่นคำร้องต่อศาลภายในกำหนดเจ็ดวันนับแต่วันยื่นคำฟ้อง เพื่อให้ศาลจัดส่งหมายเรียกและคำฟ้องตั้งต้นคดีแก่จำเลย ในกรณีเช่นว่านี้ ถ้าไม่มีข้อตกลงระหว่างประเทศที่ประเทศไทยเป็นภาคีกำหนดไว้เป็นอย่างอื่น ให้โจทก์ทำคำแปลหมายเรียก คำฟ้องตั้งต้นคดีและเอกสารอื่นใดที่จะส่งไปยังประเทศที่จำเลยมีภูมิลำเนาหรือสำนักทำการงานอยู่ เป็นภาษาราชการของประเทศนั้นหรือเป็นภาษาอังกฤษ พร้อมทั้งคำรับรองคำแปลว่าถูกต้องยื่นต่อศาลพร้อมกับคำร้องดังกล่าว และวางเงินค่าใช้จ่ายไว้ต่อศาลตามจำนวนและภายในระยะเวลาที่ศาลกำหนดในกรณีที่ศาลเห็นสมควร ศาลจะมีคำสั่งให้โจทก์จัดทำเอกสารอื่นเพิ่มเติมยื่นต่อศาลภายในระยะเวลาที่ศาลกำหนดก็ได้ในกรณีที่โจทก์เพิกเฉยไม่ดำเนินการตามวรรคหนึ่งหรือวรรคสอง ให้ถือว่าโจทก์ทิ้งฟ้องตามมาตรา ๑๗๔ในกรณีที่มีการเรียกบุคคลภายนอกซึ่งไม่มีภูมิลำเนาอยู่ในราชอาณาจักรเข้ามาเป็นคู่ความตามมาตรา ๕๗
(๓) ให้นำความในวรรคหนึ่ง วรรคสอง และวรรคสาม มาใช้บังคับโดยอนุโลม

English translation

Where the summons and the plaint initiating the action must be served under Section 83 bis on the defendant at the defendant's domicile or place of business outside the Kingdom, the plaintiff shall file a motion with the court within seven days from the date of filing the plaint, requesting the court to arrange for service of the summons and the plaint initiating the action on the defendant. In such case, unless an international agreement to which Thailand is a party provides otherwise, the plaintiff shall prepare a translation of the summons, the plaint initiating the action, and any other document to be sent to the country in which the defendant has a domicile or place of business, into the official language of that country or into English, together with a certification that the translation is correct, and file it with the court together with the said motion, and deposit with the court the expenses in the amount and within the period fixed by the court.
Where the court thinks fit, it may order the plaintiff to prepare additional documents and file them with the court within the period fixed by the court.
Where the plaintiff neglects to proceed under paragraph one or paragraph two, the plaintiff shall be deemed to have abandoned the plaint under Section 174.
Where a third person having no domicile within the Kingdom is summoned to become a party under Section 57 (3), the provisions of paragraph one, paragraph two, and paragraph three shall apply mutatis mutandis.

    Where the plaintiff fails to take the steps required to serve a foreign defendant abroad under Section 83 quater, the court may treat the plaint as abandoned and dismiss the case as to that defendant, applying Section 83 quater paragraphs one and three together with Section 174 (2) and Section 132 (1).

    Because the plaintiff did not complete the steps for serving the foreign defendant abroad, the trial court's order that the plaintiff had abandoned the plaint and its dismissal of the case as to that defendant were held lawful under Section 83 quater paragraphs one and three, Section 174 (2), and Section 132 (1). The Supreme Court added only a correction on costs, otherwise upholding the dismissal.
