สำหรับการสอบสวนซึ่งอยู่ในความรับผิดชอบของเจ้าพนักงานตำรวจในกรณีที่มีคำสั่งไม่ฟ้องและคำสั่งนั้นไม่ใช่คำสั่งของอัยการสูงสุด ถ้าในกรุงเทพมหานครให้รีบส่งสำนวนการสอบสวนพร้อมกับคำสั่งเสนอผู้บัญชาการตำรวจแห่งชาติ รองผู้บัญชาการตำรวจแห่งชาติ หรือผู้ช่วยผู้บัญชาการตำรวจแห่งชาติ ถ้าในจังหวัดอื่นให้รีบส่งสำนวนการสอบสวนพร้อมกับคำสั่งเสนอผู้บัญชาการหรือรองผู้บัญชาการ ซึ่งเป็นผู้บังคับบัญชาของพนักงานสอบสวนผู้รับผิดชอบ แต่ทั้งนี้มิได้ตัดอำนาจพนักงานอัยการที่จะจัดการอย่างใดแก่ผู้ต้องหาดังบัญญัติไว้ในมาตรา ๑๔๓ในกรณีที่ผู้บัญชาการตำรวจแห่งชาติ รองผู้บัญชาการตำรวจแห่งชาติ หรือผู้ช่วยผู้บัญชาการตำรวจแห่งชาติในกรุงเทพมหานคร หรือผู้บัญชาการหรือรองผู้บัญชาการซึ่งเป็นผู้บังคับบัญชาของพนักงานสอบสวนผู้รับผิดชอบในจังหวัดอื่นแย้งคำสั่งของพนักงานอัยการให้ส่งสำนวนพร้อมกับความเห็นที่แย้งไปยังอัยการสูงสุดเพื่อชี้ขาด แต่ถ้าคดีจะขาดอายุความ หรือมีเหตุอย่างอื่นอันจำเป็นจะต้องรีบฟ้อง ก็ให้ฟ้องคดีนั้นตามความเห็นของผู้บัญชาการตำรวจแห่งชาติ รองผู้บัญชาการตำรวจแห่งชาติ ผู้ช่วยผู้บัญชาการตำรวจแห่งชาติ ผู้บัญชาการหรือรองผู้บัญชาการดังกล่าวแล้วแต่กรณีไปก่อนบทบัญญัติในมาตรานี้ ให้นำมาบังคับในการที่พนักงานอัยการจะอุทธรณ์ ฎีกา หรือถอนฟ้องถอนอุทธรณ์และถอนฎีกาโดยอนุโลม
English translation
For an investigation under the responsibility of police officers, in the case where there is a non-prosecution order and that order is not the order of the Attorney-General: if in Bangkok, the investigation file together with the order shall promptly be submitted to the Commissioner-General, Deputy Commissioner-General, or Assistant Commissioner-General of the Royal Thai Police; if in other provinces, the investigation file together with the order shall promptly be submitted to the Commissioner or Deputy Commissioner who is the superior of the responsible inquiry official. This, however, does not preclude the power of the public prosecutor to take any action against the accused as provided in section 143.
In the case where the Commissioner-General, Deputy Commissioner-General, or Assistant Commissioner-General of the Royal Thai Police in Bangkok, or the Commissioner or Deputy Commissioner who is the superior of the responsible inquiry official in other provinces, disagrees with the order of the public prosecutor, the file together with the conflicting opinion shall be sent to the Attorney-General for a decision. But if the case would become time-barred, or there is another necessary cause requiring prompt prosecution, the case shall be prosecuted first in accordance with the opinion of the Commissioner-General, Deputy Commissioner-General, Assistant Commissioner-General of the Royal Thai Police, or the Commissioner or Deputy Commissioner, as the case may be.
The provisions of this section shall apply mutatis mutandis where the public prosecutor is to appeal, further appeal, or withdraw a prosecution, appeal, or further appeal.

It applies specifically to police-responsible investigations, whereas section 145 uses the older Police Department and Provincial Governor titles. Together they preserve the same safeguard: no non-prosecution order becomes final without an external check, with a time-bar exception permitting immediate prosecution, and the check extends to appeal and withdrawal.
