Section 246 — Suspension of Imprisonment Enforcement

เมื่อจำเลย สามี ภริยา
ญาติของจำเลย พนักงานอัยการ
ผู้บัญชาการเรือนจำหรือเจ้าพนักงานผู้มีหน้าที่จัดการตามหมายจำคุกร้องขอ
หรือเมื่อศาลเห็นสมควร ศาลมีอำนาจสั่งให้ทุเลาการบังคับให้จำคุกไว้ก่อนจนกว่าเหตุอันควรทุเลาจะหมดไป
ในกรณีต่อไปนี้
(๑) เมื่อจำเลยวิกลจริต
(๒)
เมื่อเกรงว่าจำเลยจะถึงอันตรายแก่ชีวิตถ้าต้องจำคุก
(๓) ถ้าจำเลยมีครรภ์
(๔) ถ้าจำเลยคลอดบุตรแล้วยังไม่ถึงสามปี
และจำเลยต้องเลี้ยงดูบุตรนั้นในระหว่างทุเลาการบังคับอยู่นั้นศาลจะมีคำสั่งให้บุคคลดังกล่าวอยู่ในความควบคุมในสถานที่อันควรนอกจากเรือนจำหรือสถานที่ที่กำหนดไว้ในหมายจำคุกก็ได้
และให้ศาลกำหนดให้เจ้าพนักงานผู้มีหน้าที่จัดการตามหมายนั้นเป็นผู้มีหน้าที่และรับผิดชอบในการดำเนินการตามคำสั่งลักษณะของสถานที่อันควรตามวรรคสองให้เป็นไปตามที่กำหนดในกฎกระทรวง
ซึ่งต้องกำหนดวิธีการควบคุมและบำบัดรักษาที่เหมาะสมกับสภาพของจำเลย
และมาตรการเพื่อป้องกันการหลบหนีหรือความเสียหายที่อาจเกิดขึ้นด้วยเมื่อศาลมีคำสั่งตามวรรคหนึ่งแล้ว
หากภายหลังจำเลยไม่ปฏิบัติตามวิธีการหรือมาตรการตามวรรคสามหรือพฤติการณ์ได้เปลี่ยนแปลงไป
ให้ศาลมีอำนาจเปลี่ยนแปลงคำสั่งหรือให้ดำเนินการตามหมายจำคุกได้ให้หักจำนวนวันที่จำเลยอยู่ในความควบคุมตามมาตรานี้ออกจากระยะเวลาจำคุกตามคำพิพากษา

English translation

Where the defendant, the defendant's spouse, relatives of the defendant, the public prosecutor, the prison commander, or the officer charged with executing the imprisonment warrant so requests, or where the court sees fit, the court has power to order the enforcement of imprisonment suspended until the ground for suspension ends, in the following cases: (1) when the defendant is insane; (2) when it is feared the defendant would face danger to life if imprisoned; (3) if the defendant is pregnant; (4) if the defendant has given birth and the child is not yet three years old and the defendant must care for that child during the suspension. During such suspension the court may order the said person kept in custody at a suitable place other than the prison or the place specified in the imprisonment warrant, and the court shall designate the officer charged with executing the warrant to be responsible for carrying out the order. The nature of the suitable place under paragraph two shall be as prescribed in a ministerial regulation, which must prescribe methods of custody and treatment appropriate to the defendant's condition and measures to prevent escape or any damage that may occur. After the court has made an order under paragraph one, if the defendant later fails to comply with the methods or measures under paragraph three, or if circumstances change, the court has power to alter the order or to proceed under the imprisonment warrant. The number of days the defendant is in custody under this section shall be deducted from the term of imprisonment under the judgment.

Later paragraphs, added to modernize the regime, allow the court to revoke the arrangement if the defendant breaches conditions or circumstances change, and require days in such custody to be credited against the sentence.

Why this matters in practice

This provision matters after conviction: a family member, the prosecutor, or the prison itself can move the court to suspend imprisonment on one of the four grounds, and the days spent in alternative custody reduce the sentence. It does not apply to fines, and it does not erase the sentence; it only postpones and relocates enforcement while the ground persists.     The power to suspend enforcement under section 246 applies only to an imprisonment sentence; there is no provision allowing suspension of a daily fine while the defendant works to obtain compliance documents.

    In a Building Control Act case carrying a daily fine, the Supreme Court held there is no legal basis to suspend or halt enforcement of the daily fine; only section 246 lets the court suspend enforcement of an imprisonment sentence, and it affirmed the appellate judgment.

Frequently asked questions

Can a prison sentence be delayed if the convicted person is pregnant?

Yes. Under section 246, pregnancy is one of the grounds on which the court may suspend enforcement of imprisonment until the ground ends, and it may order custody in a suitable place outside prison.

Does time in alternative custody count toward the sentence?

Yes. Section 246 requires the number of days the defendant is held in custody under this section to be deducted from the term of imprisonment in the judgment.

Does section 246 apply to fines?
