One mistyped digit sent 31,000 baht to the account of a stranger, a Myanmar national, at another bank. The police froze the funds; the bank still refused to return them. The Supreme Court ordered the bank to repay in full plus 3% interest, The account holder was not the depositor of money sent by mistake, the money was still in the bank’s hands and he never claimed it, so the sender could recover it from the bank under Civil and Commercial Code section 1336. A bank the public relies on must act in good faith and by appropriate commercial standards (the Court used the words of section 12 of the Consumer Case Procedure Act), and should have asked the account holder to come forward rather than leave the whole burden on the customer.
