Section 214: Habitually harbouring offenders

ผู้ใดประพฤติตนเป็นปกติธุระเป็นผู้จัดหาที่พำนัก ที่ซ่อนเร้นหรือที่ประชุมให้บุคคลซึ่งตนรู้ว่าเป็นผู้กระทำความผิดที่บัญญัติไว้ในภาค ๒ นี้ ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกหมื่นบาท หรือทั้งจำทั้งปรับ ถ้าการกระทำความผิดนั้น เป็นการกระทำเพื่อช่วยบิดา มารดา บุตร สามีหรือภริยาของผู้กระทำ ศาลจะไม่ลงโทษก็ได้ หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๔ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]
English translation
Whoever habitually provides a place of shelter, a hiding place, or a meeting place for a person whom that person knows to be an offender against the provisions of this Book shall be liable to imprisonment not exceeding three years, or a fine not exceeding sixty thousand baht, or both.
If the offence is committed in order to help the father, mother, child, husband, or wife of the offender, the court may decline to impose punishment.

The word habitually is the element that limits this section: a single act of shelter is not enough, and what must be proved is a pattern. The offender must also know that the person sheltered is an offender under this Book. A reduced penalty applies where the help was given to a close family member, which reflects the same policy as Section 193 in the justice Chapter, that the law will not demand that relatives inform on each other.
