ผู้ใดเป็นผู้มีวิชาชีพในการออกแบบ ควบคุม หรือทำการก่อสร้าง ซ่อมแซมหรือรื้อถอน อาคารหรือสิ่งปลูกสร้างใด ๆ ไม่ปฏิบัติตามหลักเกณฑ์ หรือวิธีการอันพึงกระทำการนั้น ๆ โดยประการที่น่าจะเป็นเหตุให้เกิดอันตรายแก่บุคคลอื่น ต้องระวางโทษจำคุกไม่เกินห้าปี หรือปรับไม่เกินหนึ่งแสนบาท หรือทั้งจำทั้งปรับ หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๔ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]
English translation
Whoever, being a professional in the design, the supervision, or the carrying out of the construction, repair, or demolition of any building or structure, fails to comply with the rules or the methods proper to that work, in a manner likely to cause danger to another person, shall be liable to imprisonment not exceeding five years, or a fine not exceeding one hundred thousand baht, or both.

This is a professional-standards offence and it applies only to a person with professional capacity in design, supervision, or the carrying out of construction, repair or demolition. The conduct is failing to comply with the rules or methods proper to that work, and the qualifier is that the failure must be likely to cause danger to another person. No collapse and no injury need occur, which makes it available where a defect is discovered before anything happens. The penalty is up to five years, or a fine of up to 100,000 baht, or both.
