Adultery

Voluntary sexual intercourse between a married person and a third party other than their spouse. Under Sections 1516(1) and 1523 of the Thai Civil and Commercial Code, adultery is a statutory ground for divorce and entitles the wronged spouse to claim compensation from both the unfaithful spouse and the third party. Adultery is no longer a criminal offence in Thailand, but remains a civil matter with significant financial consequences in a contested divorce.
