ในกรณีที่กล่าวไว้ในมาตรา ๑๐๗๐ นั้น ถ้าผู้เป็นหุ้นส่วนนำพิสูจน์ได้ว่า (๑) สินทรัพย์ของห้างหุ้นส่วนยังมีพอที่จะชำระหนี้ได้ทั้งหมดหรือบางส่วน และ (๒) การที่จะบังคับเอาแก่ห้างหุ้นส่วนนั้นไม่เป็นการยากฉะนี้ไซร้ ศาลจะบังคับให้เอาสินทรัพย์ของห้างหุ้นส่วนนั้นชำระหนี้ก่อนก็ได้ สุดแต่ศาลจะเห็นสมควร

English translation
In the case provide by Section 1070, if the partner proves: (1) That the assets of the partnership are sufficient to perform the whole or part of the obligation, and (2) That enforcement against the partnership would not be difficult. The Court may, in its discretion, order that the obligation be enforced first against the assets of the partnership.
