ในกรณีที่กล่าวไว้ในมาตรา ๑๐๗๐ นั้น ถ้าผู้เป็นหุ้นส่วนนำพิสูจน์ได้ว่า (๑) สินทรัพย์ของห้างหุ้นส่วนยังมีพอที่จะชำระหนี้ได้ทั้งหมดหรือบางส่วน และ (๒) การที่จะบังคับเอาแก่ห้างหุ้นส่วนนั้นไม่เป็นการยากฉะนี้ไซร้ ศาลจะบังคับให้เอาสินทรัพย์ของห้างหุ้นส่วนนั้นชำระหนี้ก่อนก็ได้ สุดแต่ศาลจะเห็นสมควร

Dans le cas prévu à l'article 1070, si l'associé prouve : (1) que l'actif de la société est suffisant pour s'acquitter de tout ou partie de l'obligation, et (2) que le recouvrement de la créance auprès de la société ne présenterait pas de difficulté, le tribunal peut, à sa discrétion, ordonner que le recouvrement de la créance soit d'abord effectué sur l'actif de la société.
