หนังสือบริคณห์สนธินั้น ให้ทำเป็นต้นฉบับไว้ไม่น้อยกว่าสองฉบับ และให้ลงลายมือชื่อของบรรดาผู้เริ่มก่อการ โดยมีพยานลงชื่อรับรองด้วยสองคน และให้นำฉบับหนึ่งไปจดทะเบียน
ถ้าการจดทะเบียนบริษัทมิได้ทำภายในสามปีนับแต่วันที่นายทะเบียนรับจดทะเบียนหนังสือบริคณห์สนธิ ให้หนังสือบริคณห์สนธินั้นสิ้นผล

English translation
The memorandum shall be made in not less than two original copies, signed by all the promoters, with two witnesses certifying the signatures, and one copy shall be lodged for registration.
If the registration of the company is not made within three years from the day on which the Registrar accepted the memorandum for registration, the memorandum ceases to have effect.
