Section 1411 — Superficies — duration

Unless otherwise provided in the act creating it, the right of superficies is transferable and transmissible by way of inheritance.

Firm annotation

Section 1411 sets the duration cap. Three options: (a) fixed term up to 30 years (renewable); (b) for the superficiary's life; (c) for the landowner's life. The "for life" options can outlast 30 years — useful when planning for a foreign spouse who expects to live longer than the Thai spouse. On death of the relevant party, the building reverts to the landowner unless §1416 (compensation rule) applies.
