English translation

The usufructuary is bound to keep the substance of the property unaltered, and is responsible for ordinary maintenance and pretty repairs. If important repairs or measures are necessary for the preservation of the property, the usufructuary must forthwith inform the owner thereof and permit them to be carried out. In case of default by the owner, the usufructuary may have the work carried out at the owner's expense.

Notable

Why this matters in practice

Lawyers: the usufructuary/owner split on repairs — ordinary repairs to the usufructuary, major structural repairs to the owner — should be addressed in the usufruct agreement. Failure to notify the owner of major necessary repairs before carrying them out may affect the usufructuary's right of reimbursement. Laypersons: day-to-day upkeep of the property is your responsibility as usufructuary; if something major needs fixing (like the roof structure), tell the owner in writing first and give them a chance to fix it before you do it yourself.
