Article 1424: Ordinary maintenance by the usufructuary, major repairs by the owner

ผู้ทรงสิทธิเก็บกินจำต้องสงวนภาวะแห่งทรัพย์สินมิให้เปลี่ยนไปในสาระสำคัญ กับต้องบำรุงรักษาปกติและซ่อมแซมเล็กน้อยด้วยถ้าจำเป็นต้องซ่อมแซมใหญ่ หรือมีการสำคัญอันต้องทำเพื่อรักษาทรัพย์สินไซร้ ท่านว่าผู้ทรงสิทธิเก็บกินต้องแจ้งแก่เจ้าของทรัพย์สินโดยพลัน และต้องยอมให้จัดทำการนั้น ๆ ไป ถ้าเจ้าของทรัพย์สินละเลยเสีย ท่านว่าผู้ทรงสิทธิเก็บกินจะจัดทำการนั้นไปโดยให้เจ้าของทรัพย์สินออกค่าใช้จ่ายก็ได้

English translation

The usufructuary is bound to keep the substance of the property unaltered, and is responsible for ordinary maintenance and petty repairs. If important repairs or measures are necessary for the preservation of the property, the usufructuary must forthwith inform the owner thereof and permit them to be carried out. In case of default by the owner, the usufructuary may have the work carried out at the owner's expense.

Why this matters in practice

Lawyers: the usufructuary/owner split on repairs, ordinary repairs to the usufructuary, major structural repairs to the owner, should be addressed in the usufruct agreement. Failure to notify the owner of major necessary repairs before carrying them out may affect the usufructuary's right of reimbursement. Laypersons: day-to-day upkeep of the property is your responsibility as usufructuary; if something major needs fixing (like the roof structure), tell the owner in writing first and give them a chance to fix it before you do it yourself.
