When usufruct comes to an end, the usufructuary must return the property to the owner. The usufructuary is liable for the destruction or depreciation in value of the property, unless he proves that the damage was not caused by his fault. He must replace anything which he has wrongfully consumed. He is not bound to give compensation for depreciation in value caused by reasonable use.

Avocats : la responsabilité au titre de l’article 1420 exige la preuve d’une faute de l’usufruitier ; la détérioration due à l’usage normal ou au vieillissement naturel n’est pas indemnisable. Un inventaire dressé au début de l’usufruit constitue une preuve essentielle pour cette comparaison à son terme. Particuliers : à la fin de votre usufruit, vous devez restituer le bien ; si vous l’avez endommagé au-delà de l’usure normale, vous devez indemniser le propriétaire. Conservez un document attestant de l’état du bien au moment de sa réception.
