English translation

An immovable may be subject to a usufruct by which the usufructuary is entitled to the possession, use, and enjoyment of the property. He has the right to manage the property. A usufructuary of a forest, mine, or quarry has the right to exploit the forest, mine, or quarry.

Usufruct under §1417 is the firm's most-recommended tool for foreigners who cannot own Thai land outright but wish to secure long-term residential use of a property registered in a Thai spouse's or partner's name. Key points: (1) registration at the Land Department is required, an unregistered Usufruit binds only the parties; (2) maximum term is 30 years (§1418) but can also be granted for the usufructuary's lifetime; (3) the usufructuary may sublease (§1422) for terms not exceeding the usufruct's own term; (4) on death of a lifetime usufructuary the right extinguishes automatically, it does not pass to heirs.

Why this matters in practice

Lawyers: usufruct must be registered at the Land Office to perfect as a real right. The maximum term is 30 years if fixed; if expressed to be for the holder's life, it ends on death and is not inherited. The usufructuary may lease the property to third parties within the term of the usufruct. Foreigners frequently use registered usufruct to secure long-term use of a Thai spouse's or partner's land. Laypersons: usufruct lets you live in, rent out, and earn income from someone else's property as if it were your own, but you cannot sell the land. If registered, it is valid against future owners of the land. Maximum term is 30 years per registration, but it can be renewed.

Legislative history

Part of the original Civil and Commercial Code codification; no major subsequent amendment. Usufruct is the most widely used instrument for foreigners who wish to obtain income-producing rights over Thai land and structures without direct ownership.

    An oral agreement that the giver of land shall have a usufruct over it for life, given in return for transferring the land, is a special reciprocal arrangement that creates a personal right. So long as the owner has not transferred the property to anyone else, the holder of that right may sue to compel him to register the usufruct.

    The plaintiff and the defendant, her child, agreed orally that the plaintiff would have a usufruct over the land and buildings for life in return for her transferring them to him, the defendant taking the key money from tenants while the plaintiff received only the rent. The Court held that this was a special reciprocal arrangement which gave the plaintiff a personal right to require the defendant to register the usufruct, and that so long as he had not transferred the land and buildings to anyone else she had standing to sue to compel him to do so.

Quelle est la durée maximale d'un usufruit en Thaïlande ?

Un usufruit peut être constitué pour une durée fixe ne dépassant pas 30 ans, ou pour la durée de vie de l'usufruitier : la période la plus courte étant retenue. Si une durée fixe plus longue est convenue, elle est réduite à 30 ans. Au décès de l'usufruitier, l'usufruit prend fin même si le terme fixé n'est pas échu. Le droit peut être renouvelé pour de nouvelles périodes pouvant aller jusqu'à 30 ans chacune.

Un usufruitier en Thaïlande peut-il louer son bien pour en tirer un revenu ?

Oui. L'article 1417 confère à l'usufruitier le droit de gérer le bien et d'en percevoir les fruits, y compris le droit de le louer et d'en percevoir les loyers. L'usufruitier peut utiliser le bien ou le louer, mais ne peut pas le vendre (le titre de propriété appartenant au propriétaire).

Un étranger peut-il détenir un usufruit sur un terrain en Thaïlande même s'il n'en est pas propriétaire ?

Oui. Il n'est pas interdit aux ressortissants étrangers de détenir un usufruit enregistré sur un terrain thaïlandais. L'usufruit leur confère des droits de possession, d'utilisation, de gestion et de jouissance des revenus pour une durée maximale de 30 ans (renouvelable) ou sa vie durant : fonctionnant effectivement comme une propriété à long terme de l'usage. C'est l'une des structures juridiques les plus couramment utilisées par les étrangers ayant un partenaire thaïlandais propriétaire terrien.
