Article 1422: Transferring the exercise of a usufruct to a third person

ถ้ามิได้กำหนดไว้เป็นอย่างอื่นในนิติกรรมอันก่อให้เกิดสิทธิเก็บกินไซร้ ท่านว่าผู้ทรงสิทธินั้นจะโอนการใช้สิทธิของตนให้บุคคลภายนอกก็ได้ ในกรณีเช่นนั้นเจ้าของทรัพย์สินอาจฟ้องร้องผู้รับโอนโดยตรง

English translation

Unless otherwise provided in the act creating the usufruct, the usufructuary may transfer the exercise of his right to the third person. In such case the owner of the property may sue the transferee direct.

Firm annotation

Section 1422 unlocks the income potential of Usufruit. The foreign holder of a lifetime usufruct can lease the property to tenants and collect rent, just as if they owned it, and in that case the owner of the property may sue the transferee direct. Two limits: (1) the transfer of the exercise of the right cannot outlast the usufruct itself. On the usufructuary's death the usufruct always comes to an end under s.1418 final paragraph, and a sub-lease resting on it falls with it. A sub-lessee who needs security beyond the holder's lifetime must have the owner join the lease as a party from the outset; (2) the usufructuary must still preserve the substance of the property and carry out ordinary maintenance and minor repairs under s.1424.
