ถ้ามิได้กำหนดไว้เป็นอย่างอื่นในนิติกรรมอันก่อให้เกิดสิทธิเก็บกินไซร้ ท่านว่าผู้ทรงสิทธินั้นจะโอนการใช้สิทธิของตนให้บุคคลภายนอกก็ได้ ในกรณีเช่นนั้นเจ้าของทรัพย์สินอาจฟ้องร้องผู้รับโอนโดยตรง

Unless otherwise provided in the act creating the usufruct, the usufructuary may transfer the exercise of his right to the third person. In such case the owner of the property may sue the transferee direct.

Section 1422 unlocks the income potential of usufruct. The foreign holder of a lifetime usufruct can lease the property to tenants, collecting rent, just as if they owned it. Two limits: (1) the sub-lease cannot outlast the usufruct itself — if the foreigner dies, the sub-lease also extinguishes (with one practical caveat that registered sub-leases may have separate protection under §568 for the lease's remaining term); (2) the usufructuary must continue meeting the §1419 maintenance obligations.
