Conditions that catch people out: the sale price and the appraised value must each be 7 million baht or less, and the mortgage must also be 7 million baht or less; if any one figure is over, the normal fee applies to the whole transaction. The mortgage rate is cut only when the mortgage is registered together with the qualifying sale. The property must be a house, a townhouse or shophouse, a commercial building, land with such a building on it, or a unit in a registered condominium; bare land does not qualify. These conditions are set out in the Department of Lands implementing circular MT 0515.1/W 14504 of 30 June 2026.

Transfer fees and taxes are calculated based on the property’s value, the details in the contract, and current laws. Responsibilities for these costs can vary, some contracts require the buyer to pay all fees, while others might dictate a split cost or other arrangements. Where the contract is silent, section 457 of the Civil and Commercial Code has the buyer and seller bear the costs of the sale equally. A 2% transfer fee is the main charge. There is also a 0.5% stamp duty, which the reduction does not affect. Stamp duty and Specific Business Tax are alternatives rather than cumulative: which of the two you pay turns on how long the seller has held the property, and our guide to ภาษีที่ดินและสิ่งปลูกสร้างในประเทศไทย works through both with a costed example. An individual who sells within five years of acquiring the property pays Specific Business Tax of 3.3% instead of the stamp duty, which discourages speculative sales. Section 4(6) of Royal Decree No. 342 B.E. 2541 takes several sales out of that five-year rule, and two of them matter most in practice: a sale of property the seller inherited, and a sale of the seller’s main residence where the seller’s name has been in the house registration (Tabien Baan) for at least one year from acquisition. A seller who never registered in the house cannot use the second route, whatever the reason. That 3.3% is the statutory 3% under section 91/6(3) of the Revenue Code plus the 10% local surcharge, and it is the rate in force as at September 2026. If you check the Revenue Department’s own English pages you will find 0.1% there instead. That was a stimulus reduction made by royal decree, and the last of them, No. 488 of B.E. 2552, cut the rate only for transfers registered between 29 March 2009 and 28 March 2010. No royal decree since has reduced it again. From time to time, the government can modify these taxes to stimulate the economy like in 2023 and 2024.
Withholding tax is the charge this page used to leave out, and on an ordinary sale by an individual it is often the largest of the lot. Where the seller is an individual, an ordinary partnership, a non-juristic body of persons or an undivided estate, it is worked out on the มูลค่าที่ประเมิน used for the registration fee, not on the price in the contract. A standard deduction is taken first, fixed by years held under section 4 of Royal Decree No. 165 B.E. 2529: 92 per cent for one year, then 84, 77, 71, 65, 60 and 55 per cent, and 50 per cent from the eighth year on. Inherited or gifted property takes a flat 50 per cent instead. What is left is divided by the years held, the personal income tax scale is applied to that figure, and the result is multiplied back by the years held. Years held stops at ten however long you have owned it, and part of a year counts as a whole one. For inherited property, or property not acquired to trade in, the tax cannot exceed 20 per cent of the sale price. Where the seller is a company or a juristic partnership the calculation disappears: it is a flat 1 per cent of the sale price or the appraised value, whichever is higher.
Which value each charge is calculated on decides how much any of this costs. The 2 per cent transfer fee and the individual withholding tax are both taken on the มูลค่าที่ประเมิน, the figure the Land Department holds, whatever the parties write in the contract. Stamp duty, Specific Business Tax and the corporate 1 per cent are taken on the higher of the appraised value and the declared price. So the appraised value sets a floor under the bill that no wording in the contract reaches.
What the Land Office may ask at the counter in 2026
Since May 2026 the Land Office asks more questions on larger purchases. Department of Lands circular MT 0515.2/W 10722 of 15 May 2026 tells land officers to question the buyer further under section 74 of the Land Code when an individual, or a company with Thai shareholders, buys land and either of two tests is met:
- the price is paid in cash of 2 million baht or more; or
- the property’s มูลค่าที่ประเมิน for registration-fee purposes is 5 ล้านบาทขึ้นไป. This is the government figure, not the price in your contract.
The officer can then ask where the money came from, and about the buyer’s income, occupation and financial standing. A transfer of an inheritance to a statutory heir is excepted. Bring bank statements showing the funds and their origin, and proof of income, so the registration is not held over to another day. The circular is aimed at land held for foreigners through Thai nominees, and on 25 August 2026 the Ministry of Interior added police and tax officials to the provincial committees that examine suspect cases. This does not apply to a condominium bought under the foreign quota, which has its own rules. While this request has become less common recently, foreigners might still need to provide parental details verbally, without needing to show documentation.

The actual transfer process can take anywhere from 30 minutes to a full day, depending on how busy the Land Department is and whether the documentation is prepared beforehand. Once fees and taxes are settled, payment is made to the seller, typically via cash, cashier’s check, or bank transfer.
You must agree on how the payment is made with the seller before going to the land department. Many people still pay in cash, but a cash payment of 2 million baht or more now triggers the source-of-funds questions described above. Below the two thresholds there is no standing instruction to question where the money came from, although the officer’s power under section 74 of the Land Code applies to every registration. Declaring a lower price than the one actually paid is still common, and it is still unlawful. It also saves less than people expect: the transfer fee and an individual seller’s withholding tax are taken on the appraised value whatever the contract says. A false statement to the land officer can be prosecuted under sections 137 and 267 of the Penal Code, which the Department of Lands cites in its 2026 circulars.

The buyer receives the title deed (โฉนด) after the payments and registration by the land department are completed. If there are any additional rights like a usufruct or lease to be registered, these can generally be handled on the same day. Unless the title deed is Nor Sor Sam, which requires a 30-day ระยะเวลาแจ้งลาออก due to the need for public announcements. So they name the transfer of the property and the usufruct at the same time.

The process of transferring property as a ของขวัญ (e.g., a father to a daughter) or through inheritance follows similar steps. In these cases, Thai people often navigate the process without legal assistance, as they are mostly familiar with the procedures and requirements. If not, they can call their local land department. How long does a land transfer take in Thailand?
The registration itself usually takes from 30 minutes to a full day at the Land Office, depending on the queue and on whether the documents were prepared in advance. A purchase that meets the 2026 source-of-funds thresholds can take longer if the officer asks for evidence you did not bring.
Who pays the transfer fee?
Unless the contract says otherwise, section 457 of the Civil and Commercial Code has the buyer and seller bear the costs of the sale contract equally. Most contracts say who pays each fee and tax, and some put everything on the buyer, so agree it in writing before transfer day.
Does the Land Office check where my money came from?
Since May 2026, yes, on larger purchases. Under Department of Lands circular W 10722 the officer questions the buyer about the source of funds, income and occupation when the price is paid in cash of 2 million baht or more, or when the appraised value is 5 million baht or more. A transfer of an inheritance to a statutory heir is excepted.
Do foreigners get the 0.01% transfer fee?
No. The reduction to 0.01% that runs to 30 June 2027 is limited to buyers who are individual Thai nationals. A foreigner buying a condominium unit under the foreign quota pays the standard 2% transfer fee.
When do I pay 3.3% Specific Business Tax instead of 0.5% stamp duty?
An individual pays Specific Business Tax when selling within five years of acquiring the property. It does not apply to a sale of inherited property, or to a sale of the seller’s main residence where the seller’s name has been in its house registration for at least one year. Where Specific Business Tax is not due, 0.5% stamp duty is paid instead.
Can I transfer property with a power of attorney?
Yes. If a buyer or seller cannot attend the Land Office, they can appoint someone to act for them by power of attorney, and the attorney completes the registration on their behalf.
