Private Loan Agreement for Thailand (English and Thai)
Lending money to a partner, a family member or a friend in Thailand? Thai law requires written evidence signed by the borrower for any loan over 2,000 baht, and limits interest to 15% per year. What the agreement covers
- Amount, and how the borrower receives the money (cash or bank transfer)
- No interest, or interest up to the legal maximum of 15% per year
- Repayment in one payment or monthly instalments, early repayment without penalty
- Default interest and a simple notice procedure if payments are late
- Stamp duty, notices, Thai law and courts
- Consent of the lender’s spouse when the money is marital property, and optional signature of the borrower’s spouse
