What the consultation settles

• Whether you can divorce by agreement. A divorce by mutual consent must be in writing and signed by at least two witnesses (Civil and Commercial Code, section 1514), and where the marriage was registered in Thailand it takes effect only when the divorce itself is registered (section 1515). • What happens to the children. On a divorce by agreement the spouses must agree in writing which of them exercises parental power over each child, and if they cannot agree the court decides (section 1520). A child whose parents never married becomes the father’s legitimate child only if the parents later marry, the father registers the child, or a court so orders (section 1547); see การรับรอง และ child custody guide.
• What happens to the property. Which assets are marital property and which belong to one spouse alone, and what has to be recorded before anything is transferred. See property division on divorce.

A deadline you can lose

A court divorce based on adultery, serious misconduct, serious harm or insult, or failure to support must be brought within one year of the day you knew, or should have known, the facts (section 1529). The same one-year limit applies to a claim for compensation under section 1523. If one of those grounds is what you would rely on, say when you learned of it in the form.

What to have ready

Your marriage certificate, both passports, the children’s birth certificates, the title documents or statements for the main assets, and any agreement, notice or court document either of you has already signed or received. Copies are enough for the consultation.
