ผู้ทรงสิทธิเก็บกินจำต้องสงวนภาวะแห่งทรัพย์สินมิให้เปลี่ยนไปในสาระสำคัญ กับต้องบำรุงรักษาปกติและซ่อมแซมเล็กน้อยด้วยถ้าจำเป็นต้องซ่อมแซมใหญ่ หรือมีการสำคัญอันต้องทำเพื่อรักษาทรัพย์สินไซร้ ท่านว่าผู้ทรงสิทธิเก็บกินต้องแจ้งแก่เจ้าของทรัพย์สินโดยพลัน และต้องยอมให้จัดทำการนั้น ๆ ไป ถ้าเจ้าของทรัพย์สินละเลยเสีย ท่านว่าผู้ทรงสิทธิเก็บกินจะจัดทำการนั้นไปโดยให้เจ้าของทรัพย์สินออกค่าใช้จ่ายก็ได้

The usufructuary is bound to keep the substance of the property unaltered, and is responsible for ordinary maintenance and pretty repairs. If important repairs or measures are necessary for the preservation of the property, the usufructuary must forthwith inform the owner thereof and permit them to be carried out. In case of default by the owner, the usufructuary may have the work carried out at the owner's expense.
