ในกรณีที่คู่สมรสไม่สามารถที่จะอยู่กินด้วยกันฉันคู่สมรสโดยปกติสุขได้ หรือถ้าการอยู่ร่วมกันจะเป็นอันตรายแก่กายหรือจิตใจหรือทำลายความผาสุกอย่างมาก คู่สมรสฝ่ายใดฝ่ายหนึ่งที่ไม่สามารถจะอยู่กินด้วยกันฉันคู่สมรสโดยปกติสุขได้หรือฝ่ายที่จะต้องรับอันตรายหรือถูกทำลายความผาสุกอาจร้องต่อศาลเพื่อให้มีคำสั่งอนุญาตให้ตนอยู่ต่างหากในระหว่างที่เหตุนั้น ๆ ยังมีอยู่ก็ได้ ในกรณีเช่นนี้ ศาลจะกำหนดจำนวนค่าอุปการะเลี้ยงดูให้ฝ่ายหนึ่งเสียให้แก่อีกฝ่ายหนึ่งตามควรแก่พฤติการณ์ก็ได้

English translation
Where spouses cannot live together as spouses in normal happiness, or where living together would be a danger to body or mind or would seriously destroy their well-being, the spouse who cannot live together in normal happiness, or who would suffer the danger or the destruction of well-being, may apply to the court for an order permitting them to live apart while that cause continues. In such a case the court may fix the amount of maintenance to be paid by one spouse to the other as is appropriate in the circumstances.
