Section 1476: Acts needing both spouses' consent

คู่สมรสต้องจัดการสินสมรสร่วมกันหรือได้รับความยินยอมจากอีกฝ่ายหนึ่งในกรณีดังต่อไปนี้

(๑) ขาย แลกเปลี่ยน ขายฝาก ให้เช่าซื้อ จำนอง ปลดจำนอง หรือโอนสิทธิจำนอง ซึ่งอสังหาริมทรัพย์หรือสังหาริมทรัพย์ที่อาจจำนองได้

(๒) ก่อตั้งหรือกระทำให้สุดสิ้นลงทั้งหมดหรือบางส่วนซึ่งภาระจำยอม สิทธิอาศัย สิทธิเหนือพื้นดิน สิทธิเก็บกิน หรือภาระติดพันในอสังหาริมทรัพย์

(๓) ให้เช่าอสังหาริมทรัพย์เกินสามปี

(๔) ให้กู้ยืมเงิน

(๕) ให้โดยเสน่หา เว้นแต่การให้ที่พอควรแก่ฐานานุรูปของครอบครัวเพื่อการกุศล เพื่อการสังคม หรือตามหน้าที่ธรรมจรรยา

(๖) ประนีประนอมยอมความ

(๗) มอบข้อพิพาทให้อนุญาโตตุลาการวินิจฉัย

English translation

Spouses must manage the marital property jointly, or with the consent of the other, in the following cases:

(1) selling, exchanging, selling with a right of redemption, letting on hire purchase, mortgaging, discharging a mortgage, or transferring the right of mortgage, of immovable property or of movable property which may be mortgaged;

(2) creating or extinguishing, in whole or in part, a servitude, a right of habitation, a superficies, a usufruct, or a charge on immovable property;

(3) letting immovable property for more than three years;

(4) lending money;

(5) making a gift, except a gift appropriate to the family's condition in life for a charitable purpose, a social purpose, or a moral obligation;

(6) making a compromise;

(7) submitting a dispute to arbitration;

(8) giving property as security or as a guarantee to an official or to a court.

Management of the marital property other than in the cases in paragraph one may be carried out by either spouse without the consent of the other.

For lawyers: check whether a land transaction involving a married person requires spousal consent; if not obtained, the non-consenting spouse may petition to set aside the transaction within one year of knowledge or ten years of the act. For clients: if your spouse sold, mortgaged, or gave away jointly-owned land without your consent, you may have grounds to reverse the transaction: act within one year of finding out.

Supreme Court decisions interpreting this section

  1. Supreme Court Judgment No. 10633/2551 (2008)

    A sale with a right of redemption of marital property made by one spouse without the other's consent contravenes section 1476(1). Where the buyer did not act in good faith, the other spouse may have the transaction revoked in its entirety under section 1480, not merely as to her own share.

    The plaintiff and defendant 1 acquired the land and buildings during their marriage, so they were marital property under section 1474(1). Defendant 1 sold them with a right of redemption to defendant 2 without the plaintiff's consent, which was contrary to section 1476(1); and because defendant 2 did not buy in good faith, the plaintiff was entitled to have the whole transaction revoked under section 1480. As the action sought revocation so that the property would be returned to the plaintiff and defendant 1, it was an action for relief capable of being valued in money.

  2. Supreme Court Judgment No. 7978/2542 (1999)

    Where one spouse mortgages marital property without the other's consent, contrary to section 1476(1), and the mortgagee takes it in bad faith, the other spouse may sue to revoke the mortgage under section 1480 paragraph one. But revocation under section 1480 must be of the whole juristic act: a spouse cannot ask to revoke only her own share.

    Defendant 1 mortgaged the disputed marital property to defendant 2, a bank, without the consent of the plaintiff, his lawful wife, contrary to section 1476(1). The bank accepted the mortgage on the strength of consent given by V., a woman with whom defendant 1 had not registered a marriage, so both defendants had joined in the mortgage in bad faith and unlawfully and had infringed the plaintiff's rights; she therefore had standing to sue for its revocation under section 1480 paragraph one. The record dividing the property between the spouses was a contract made during marriage under section 1469, which the plaintiff had validly avoided while they were still married, so the property was marital property again when she sued. Revocation under section 1480 must extend to the whole juristic act, and a spouse cannot revoke only her own share.
