Section 1750: How an estate is divided among the heirs

การแบ่งปันทรัพย์มรดกนั้น อาจทำได้โดยทายาทต่างเข้าครอบครองทรัพย์สินเป็นส่วนสัด หรือโดยการขายทรัพย์มรดกแล้วเอาเงินที่ขายได้มาแบ่งปันกันระหว่างทายาท ถ้าการแบ่งปันมิได้เป็นไปตามวรรคก่อน แต่ได้ทำโดยสัญญา จะฟ้องร้องให้บังคับคดีหาได้ไม่ เว้นแต่จะมีหลักฐานเป็นหนังสืออย่างหนึ่งอย่างใด ลงลายมือชื่อฝ่ายที่ต้องรับผิดหรือตัวแทนของฝ่ายนั้นเป็นสำคัญ ในกรณีเช่นนี้ให้นำมาตรา ๘๕๐, ๘๕๒ แห่งประมวลกฎหมายนี้ว่าด้วยประนีประนอมยอมความมาใช้บังคับโดยอนุโลม

English translation

Division of an estate may be made by the heirs taking possession of the property in specified shares, or by selling the estate and dividing the proceeds among the heirs.

If the division is not made as provided in the preceding paragraph but is made by agreement, no action may be brought to enforce it unless there is some written evidence signed by the party liable or by his agent. In that case Section 850 and Section 852 of this Code, on compromise, apply mutatis mutandis.
