ทายาทคนใดครอบครองทรัพย์มรดกซึ่งยังมิได้แบ่งกัน ทายาทคนนั้นมีสิทธิที่จะเรียกร้องให้แบ่งทรัพย์มรดกนั้นได้ แม้ว่าจะล่วงพ้นกำหนดอายุความตามมาตรา ๑๗๕๔ แล้วก็ดี สิทธิที่จะเรียกให้แบ่งทรัพย์มรดกตามวรรคก่อน จะตัดโดยนิติกรรมเกินคราวละสิบปีไม่ได้

English translation
An heir in possession of an undivided estate is entitled to claim its division even after the period of prescription under Section 1754 has expired.
The right to claim division under the preceding paragraph cannot be excluded by juristic act for more than ten years at a time.
