ถ้ามีคดีฟ้องเรียกทรัพย์มรดก ผู้ซึ่งอ้างว่าตนเป็นทายาทมีสิทธิในทรัพย์มรดกนั้น จะร้องสอดเข้ามาในคดีก็ได้แต่ศาลจะเรียกทายาทอื่น นอกจากคู่ความ หรือผู้ร้องสอด ให้เข้ามารับส่วนแบ่ง หรือกันส่วนแห่งทรัพย์มรดกไว้เพื่อทายาทอื่นนั้นไม่ได้

English translation

Where an action is brought to recover an estate, a person alleging that he is an heir entitled to that estate may intervene in the action.

The court may not summon heirs other than the parties or the intervener to come in and take a share, nor set aside any part of the estate for such other heirs.
