Section 193/17: Where an interrupted prescription is treated as never interrupted

ในกรณีที่อายุความสะดุดหยุดลงเพราะเหตุตามมาตรา ๑๙๓/๑๔ (๒) หากคดีนั้นได้มีคำพิพากษาถึงที่สุดให้ยกคำฟ้อง หรือคดีเสร็จไปโดยการจำหน่ายคดีเพราะเหตุถอนฟ้อง หรือทิ้งฟ้อง ให้ถือว่าอายุความไม่เคยสะดุดหยุดลง ในกรณีที่คดีนั้นศาลไม่รับหรือคืนหรือให้ยกคำฟ้องเพราะเหตุคดีไม่อยู่ในอำนาจศาล หรือศาลให้ยกคำฟ้องโดยไม่ตัดสิทธิโจทก์ที่จะฟ้องใหม่ และปรากฏว่าอายุความครบกำหนดไปแล้วในระหว่างการพิจารณา หรือจะครบกำหนดภายในหกสิบวันนับแต่วันที่คำพิพากษาหรือคำสั่งนั้นถึงที่สุด ให้เจ้าหนี้มีสิทธิฟ้องคดีเพื่อตั้งหลักฐานสิทธิเรียกร้องหรือเพื่อให้ชำระหนี้ภายในหกสิบวันนับแต่วันที่คำพิพากษาหรือคำสั่งนั้นถึงที่สุด

English translation

Where prescription has been interrupted for a reason under Section 193/14(2), if the court has given a final judgment dismissing the action, or the action has been disposed of by withdrawal or abandonment, the prescription is deemed never to have been interrupted.
Where the court refuses, returns, or dismisses the action on the ground that it is outside the court's jurisdiction, or dismisses the action without prejudice to the plaintiff's right to bring a fresh action, and it appears that the prescription period expired during the proceedings, or will expire within sixty days from the day on which that judgment or order becomes final, the creditor is entitled to bring an action to establish the claim, or to require performance, within sixty days from the day on which that judgment or order becomes final.
