เมื่ออายุความครบกำหนดแล้ว ลูกหนี้จะสละประโยชน์แห่งอายุความนั้นเสียก็ได้ แต่การสละประโยชน์เช่นว่านี้ไม่มีผลกระทบกระเทือนสิทธิของบุคคลภายนอกหรือผู้ค้ำประกัน
