ถ้าการที่จ้างยังทำไม่แล้วเสร็จอยู่ตราบใด ผู้ว่าจ้างอาจบอกเลิกสัญญาได้ เมื่อเสียค่าสินไหมทดแทนให้แก่ผู้รับจ้างเพื่อความเสียหายอย่างใด ๆ อันเกิดแต่การเลิกสัญญานั้น
