ถ้าโดยพฤติการณ์พึงคาดหมายได้ว่าเขารับฝากทรัพย์ก็เพื่อจะได้รับบำเหน็จค่าฝากทรัพย์เท่านั้นไซร้ ท่านให้ถือว่าเป็นอันได้ตกลงกันแล้วโดยปริยายว่ามีบำเหน็จเช่นนั้น
