ถ้าการรับฝากทรัพย์เป็นการทำให้เปล่าไม่มีบำเหน็จไซร้ ท่านว่าผู้รับฝากจำต้องใช้ความระมัดระวังสงวนทรัพย์สินซึ่งฝากนั้นเหมือนเช่นเคยประพฤติในกิจการของตนเองถ้าการรับฝากทรัพย์นั้นมีบำเหน็จค่าฝาก ท่านว่าผู้รับฝากจำต้องใช้ความระมัดระวังและใช้ฝีมือเพื่อสงวนทรัพย์สินนั้นเหมือนเช่นวิญญูชนจะพึงประพฤติโดยพฤติการณ์ดังนั้น ทั้งนี้ ย่อมรวมทั้งการใช้ฝีมืออันพิเศษเฉพาะการในที่จะพึงใช้ฝีมือเช่นนั้นด้วยถ้าและผู้รับฝากเป็นผู้มีวิชาชีพเฉพาะกิจการค้าขาย หรืออาชีวะอย่างหนึ่งอย่างใด ก็จำต้องใช้ความระมัดระวังและใช้ฝีมือเท่าที่เป็นธรรมดาจะต้องใช้และสมควรจะต้องใช้ในกิจการค้าขายหรืออาชีวะอย่างนั้น

English translation

Where the deposit is gratuitous, the depositary must take such care of the property deposited as he would take of his own.

Where the deposit is for remuneration, the depositary must take such care and use such skill in keeping the property as a reasonable person would in the circumstances, including any special skill that ought to be used.

Where the depositary follows a profession, trade or occupation, he must take such care and use such skill as is normally and reasonably required in that trade or occupation.
