ในการบังคับจำนองตามมาตรา ๗๒๘ ถ้าไม่มีการจำนองรายอื่นหรือบุริมสิทธิอื่นอันได้จดทะเบียนไว้เหนือทรัพย์สินอันเดียวกันนี้ ผู้รับจำนองจะฟ้องคดีต่อศาลเพื่อเรียกเอาทรัพย์จำนองหลุดภายในบังคับแห่งเงื่อนไขดังจะกล่าวต่อไปนี้แทนการขายทอดตลาดก็ได้ (๑) ลูกหนี้ได้ขาดส่งดอกเบี้ยมาแล้วเป็นเวลาถึงห้าปี และ (๒) ผู้รับจำนองแสดงให้เป็นที่พอใจแก่ศาลว่าราคาทรัพย์สินนั้นน้อยกว่าจำนวนเงินอันค้างชำระ

English translation
In enforcing a mortgage under Section 728, if there is no other mortgage and no other preferential right registered over the same property, the mortgagee may, instead of a sale by public auction, bring an action in court to have the mortgaged property foreclosed, subject to the following conditions:
(1) the debtor has been in default of interest for five years; and
(2) the mortgagee satisfies the court that the value of the property is less than the amount outstanding.
